Good morning:
Prosecuting Attorney Bob Culloch has publicly stated that a transcript of the proceedings before the grand jury investigating the Michael Brown shooting will be released, if the grand jury decides not to indict Officer Darren Wilson.

For three months, prosecuting attorney Robert McCulloch has said he would seek a rare court order from Judge Carolyn Whittington immediately releasing nearly all evidence should Ferguson Police Officer Darren Wilson not be charged. Grand jury proceedings usually remain secret.
“We’ve asked the judge to do that, and the judge has agreed that she will do that, if there is no indictment,” McCulloch said during a radio interview with KTRS in September. “There’s no probably about it, it will be released.”
On Sunday, however, the court said, “Judge Whittington has entered no such order and has made no such agreement,” according to director of judicial admnistration Paul Fox.
I do not believe Judge Whittington will order the evidence released.
Grand jury proceedings are secret in order to protect witnesses from potential public criticism, condemnation and retaliation. Not even their identities can be disclosed, much less their testimony, especially in an extremely controversial case like this one where threats to kill have been uttered and public officials are preparing for a war to break out. The situation is so tense that Governor Nixon has preemptively declared a state of emergency and called out the National Guard.
Under these circumstances, where public disclosure of witness identities and testimony could be a death sentence, I cannot imagine that a judge would lift the veil of secrecy. I certainly would not risk people’s lives to provide political cover for McCulloch’s decision to try Wilson in secret.
There is only one way to handle this case properly and that is to charge Wilson with murder and accord him a public trial with due process of law.
To be clear, I have never believed McCulloch was operating in good faith.
Since August 9th when Darren Wilson killed an unarmed Michael Brown at noon on a quiet residential street in Ferguson before witnesses who described an execution, he has been working diligently to protect Wilson by shepherding him through a secret grand jury investigation.
I believe he knew the transcripts would not be released to the public, but chose to assure everyone that they would be released in order to place public attention on the judge who would refuse to release them and thereby conceal his misconduct.
Voters need to get rid of this racist schemer next time around.

After the shooting, Darren Wilson “In no apparent distress,” right after thinking he was about to be killed, then fearing “hostility” and realizing he killed someone, and all like that? Remember Fogen being the same — no apparent distress — by the time the EMTs took his vital signs in the cop car right after HIS kill?
And we got around to believing Wilson took a punch to the face? I still have that in the Fogen category of the smashes to the head.
OK, I’m really interested in the bizarre piece of writing known as the diary of “Witness 40.” First of all the person claims that the reason s/he was even IN Ferguson was that, like a zoo, s/he was visiting there to see people s/he referred to as “niggers” and specifically because s/he hoped to stop calling them “niggers” and stop hating the whole race because of something that happened “40 years ago.” So this person was accustomed to referring to African Americans as “niggers” to start with.
Is this person a reliable witness to anything? Is it believable that the person is IN Ferguson that day at that time — so the person does not work?
Then you have the information that the person was told to “Lay yo stupid ass down,” as if somebody (who, one of those bad people that Witness-40 was trying to learn not to hate?) was advising caution while there was gunfire?
If anybody can tell me where to find the text of that whole “diary entry” (really? Not likely) I would most appreciate it.
And then the accounting of the shooting reads like a witness statement not a diary entry. Bet the entries we saw were the first entries of the ridiculous piece of fiction
At least the Ferguson hashtag makes it easy to block all the bigots. So there’s that.
Just occurred to me: According to Wilson, Brown “looked like a demon” after having been SHOT. Jeez. Maybe he was angry? Maybe he was in pain? Maybe he was very sick because one or more of his internal organs was pierced and his body was reacting? So now there are rules for how a black man should LOOK after he has been half killed, is that it? He should perhaps smile, look nice, look like an ANGEL? Not like a “demon”?
A person wounded and looking at the barrel of a gun about to kill them will have a look of extreme terror, I would presume. Just like a person about to be killed would scream in a manner that is out of the ordinary.
Wilson stole Brown’s final look just as Zimmerman stole Martin’s final cry.
So…Darren Wilson killed Michael Brown because Brown “looked like a demon.” So delusional white cops are on the force who are free to kill people when they hallucinate, right? Or did I get that wrong. Did it go like this: “I’m a white authority figure so I’m on god’s side; he’s a black so he’s a demon so I’m allowed to kill him”?
Because it’s either one or the other. If the picture of a “demon” is “a 6’3″ black man who does not belong to your daddy’s plantation” then it’s perfectly comprehensible.
If a man killed his wife because she had a confrontation with her during which he said “she looked like a demon” would he get off?
If a woman killed her husband because he had a confrontation with her during which she said “he looked like a demon” would SHE?
That quote spoke volumes. But yes, basically today a person wearing a badge can murder someone in the street from more than 150 feet away, and then get on with his life, which includes getting married to a fellow KKK member- while the rest of us serve 8-year prison sentences for driving sober and obeying the traffic laws, in Kentucky. Yup. That sounds about right.

Lots of dialogue in Killer of Children Darren Wilson’s version of the story. Everyone must have been talking extremely quickly because the whole incident only lasted about 90 seconds.
I know. They had a whole Shakespearean soliloquy going on. “To murder or not to murder, that is the question. Whether it is nobler in the minds eye to suffer the slings and arrows of a mouthy kid or to shoot him 7 times and kill him.”
I haven’t read DW’s testimony, but the bizarre diary entries from Witness 40 read like complete fabrications. No one writes a diary like that. With a bunch of short entries and then a long accounting of the shooting with enough details to support DW. I don’t think that witness was anywhere near the shooting.

My take on this is that the “friend” who was calling the radio station and saying Michael Brown “bum-rushed” the officer then noticed that the entire web lit up with people saying she was full of crap, so she either wrote out this ignorant piece of bullshit or she got someone else to do it, off a script designed to make people (who were not used to or interested in critical thinking) believe that an eye-witness nobody interviewed was coming in with new information in the 11th hour.

Notice, too, that Brown delivered half a dozen murderous blows BEFORE handing off the cigars to his friend to free up that other hand. Miraculous!

Oh my I just realized: Wilson forgot to say that he was screaming “Help Help Help” the whole time.
If Officer Child Killer was familiar at all with the people in the neighborhood, his encounter with the young African American teens should have gone something like this:
“Hey Big Mike! Whose your friend?, How y’all doing today? Now tell me why y’all walking in the middle of the street? Why don’t y’all get back on the sidewalk before you get hit by a car. Now Big Mike, tell me, am I going to have to call your grandma?”.
According to his friend “Jay”, Officer Child Killer preferred patrolling the African American neighborhood where the crime rate was higher than the predominately white neighborhood he could have patrolled which had a much lower crime rate.
By now, we all know the real reason he preferred the African American neighborhood.
Officer Child Killer was nothing more than a thug with a badge and a license to commit an execution in broad daylight.
How ironic that McKlanner waxed poetic about how witnesses get confused about “details”, yet Wilson has minute events about a so-called fight that he remembered clear as a bell.
BBC News is reporting that since the announcement by the GJ, a 30 day state of emergency has been declared for the state of Missouri.
It was not stated why, and for what reasons.
They should make it 60 days.

I just went over to take a peek at his medical records, hoping to find out body weight.
What I noticed while scrolling through, was that the diagnosis was: ALLEDGED ASSAULT!!!
The prosecutor also was critical of the media, saying “the most significant challenge” for his office was a “24-hour news cycle and an insatiable appetite for something — for anything — to talk about.”
Yeah, like those leaks reported by the St. Louis Dispatch and other news organizations which came directly from McColored & Co.

If grand jury transcripts were to be revealed publicly, I wouldn’t believe a word of them. Since the minority of the grand jury would not have been involved in making the decision for a no-bill, and since only the minority would have any incentive to get the REAL truth out about what took place there, the prosecutor could promulgate any made-up faked-up fraudulent lying bullshit he wanted to, redacted to the extent he thought fashionable or cute, and that would stand because the minority, who would want to tell the truth about what took place, would know that they would immediately be:
(a) disbelieved and (b) prosecuted for violating the secrecy of the grand jury (if not found to be “bum-rushing” and killed outright). Once you have a gestapo force ruling a town (a county, a state, a region, a nation) as WE HAVE, nobody can speak truth to power for very long. Once you have a gestapo force carrying out protected murders, there is no peaceful answer to anything. We must resort to self-defense because our law is not a defense.

A spokesman for his office already seems to confirm they will distribute PARTIAL records from GJ hearings. IN other words, the parts THEY want the press to report on. USA Today reporting that family has been told that the officer won’t be indicted. CNN is saying that Wilson has not been told to turn himself in. “Most” of documents are being released from grand jury after announcement. Governor giving 20 minute statement afterward. Do the math. It is what we thought from the beginning. No indictment.
Time to see that it’s legal for white cops to kill black kids in our country, without cause of any sort. We need to admit this. Nobody needs 20 minutes to understand this.

Let’s examine this evidence: Darren Wilson ran after and fired more than nine shots into/at an unarmed non-threatening teen-ager and killed him, then swaggered back and forth on the street for four hours while the body lay there marking the pavement with blood. Let’s examine it. Let’s see: um … this really gets complicated … so … OK the cop killed the kid? What does that mean? Wow, it’s so complicated! I mean, it’s not like you could just figure something like that out in a couple of months or anything. It takes a lot of waiting for all the evidence to get in. … yeah, hard to figure out.

When it was announced within the past few days that Officer Child Killer would be resigning from the police department, I knew then McColored and Co. had made a back door deal with him.
This whole matter of sending it to the GJ was just what we all thought. They conducted a secret trial, which is suppose to be illegal, so I thought.
Then, they basically made a back door “flea” bargain deal with menace to society.
BTW, whatever happened to the African American woman who was co-assigned to the State’s mockery of a GJ?
Don’t remember her name, but have not heard anything more about her since it was announced in late August or September that she would be the lead in the GJ investigation.

Well, let’s just hope and pray the cops don’t kill this one too. Not necessarily good, when the police are on the ‘lookout,’ given the recent shootings.

WHY make an announcement about the GJ decision at NIGHT?
Because they want an excuse to shoot and kill more black people.
So they can test out the night vision equipment given to them by the military as “protect and serve” becomes “bait and kill”.
For example, they can disperse a crowd and a few who think they have cover in the woods can be “targeted”.
My thought is at dark you won’t see the officers face who is shooting at the protestors.
Ask a larger question, Malisha. Why has every single action, including this presser, the officials in this case have taken seem to be done with the purpose of inciting a riot. From releasing the video of MB in the convenience store while refusing to release Wilson’s name to the police overreaction to the first protesters to the oh-so-obvious leaks in the grand jury to scheduling this presser at night, while sending out a media notice hours ahead of time – allowing “instigators” time to get into place; have they not done the exact opposite of what a group of responsible officials would do? Are we to believe the entire lot of them are that stupid? Racist, yes. Stupid? ALL of them? I just can’t buy that.
Are we watching the bright shiny object while something equally as sinister, but far more covert, is taking place in the background while our attention is rightfully focused on MB, his family and LEOs who receive no consequences for their actions? Is there a reason high ranking MO officials want Ferguson to burn?
Is there a reason someone wants businesses run out of Ferguson and property values to drop? If we look back at Ferguson in a couple years and follow the money, will we find that a large campaign contributor to a high ranking official has suddenly come into possession of property in Ferguson, at rock bottom prices?
“I’m gonna ask a judge to reveal the transcript of the Grand Jury” is an abominable lie, meant to mollify people about the goodness of the racist bastard who ordered (as if from a catalog of KKK party favors) the no-bill. He knows damn well the judge will not do that; if any judge DID do that his career would be over in 10 seconds. And it wouldn’t work, because the order would be overturned within 24 hours. It’s all theater.

Their worship of the presumed “objectivity” of mostly whites doing their duty avoids a rather logical premise that was part of our nations founding – checks and balances.
How can one expect Brown to get justice in a proceeding wherein there is no person ardently assembling the evidence in his favor?
Do they really believe that the prosecutor or those he selected, who rely on the police in a close working relationship, are going to ardently go against Wilson?
True justice demands a vigorous prosecution on behalf of Brown and an equally vigorous defense on the part of Wilson.
The above is at the heart of why police commit hundreds of homicides in the USA per year and only a few are deemed a crime.
Think about that.
They kill people with a probability, based on our “perfect” justice system, of >99.5% justifiable.
No logical person would accept those odds as being valid.

I’m seeing photos of locked mailboxes in downtown Ferguson on Twitter. Sounds like the no bill came Friday and the 48-hour heads-up to LEO and NG is over. Looks like STL officials are ready to rumble with protestors. LA area folks are planning to head to the protest site.
Some news outlets are saying the announcment may come later today, which sounds almost like an indictiment. Cuz they;d need 48 hours for LEO and NG to be ready for a no bill. But I’m likely hoping too much.
I don’t think there is any chance of an indictment and remember even if he is indicted, it will be this corrupt prosecutor’s office who prosecutes him. There will be no justice from this route.
True, but it can lead to change anyway, because there will be ongoing protests and more people involving themselves in community activism both in Ferguson and around the country. Kelly’s Army has not let up in S Cali and he was killed in 2011, cops indicted in 2012, and they walked in 2013. We will never forget, nor will anyone who is following any case of murder by cop. We will change this eventually.

This case is a sad reflection on the state of things. I think McCullough is highly highly suspect but that it was the cowardice of Governor Nixon that saddens me the most. He could have appointed a special prosecutor from the first week and this case would already be on trial. He didn’t want the responsibility, and peoples lives are on the line to protect his ass for re-election.
The FBI and Justice Department are a joke and don’t seem the wee bit concerned that the KKK leader Frank Ancona hanging out with cops at the Ferguson department. It is quite obvious there is a KKK connection to multiple police officers there. They should be doing a serious investigation into that department for conspiracy to coverup a murder.

During an interview back in August, the murderer’s friend, “Jay”, said something to the effect that, “He would never do something so stupid”, and “He preferred patrolling the African-American neighborhood of Ferguson to that of white neighborhoods whose crime rates were much lower”.
I was really thought “Jay” was going to tell the interviewer the murderer preferred patrolling the African-American neighborhood of Ferguson because he really enjoyed all the free meals of collard greens and cornbread at “Mrs. Mattie’s” house, a fictional elderly African American woman.
You know, like what McSnitch (fogen) said about him and Shellie tutoring and making boloney sandwiches for the 2 “colored” children.
Well what the murderer did was not only stupid, it was criminal. Now we know the real reason he preferred patrolling the African-American neighborhood of Ferguson.
We know, and the murderer knew and knows, he would have never received an award/commendation for arresting a white man who was parked in his car, in his own yard committing a crime similar to, or same as, the one committed by the African American man.
Who’d thunk, a cop would receive an award/commendation for simply doing his job? It’s not like he saved a resident of Ferguson from a near drowning.
Professor, regarding the identities of the GJ:
Yes, I also agree that we have been “led to believe” the identities of the GJ are secret, and never to be revealed. However, about 30 years ago in Florida there was a major drug case involving “big time” drug lords as defendants.
The members of the jury were sequestered in a hotel for over a month. The trial ended as a mistrial due to one of the court clerks recognizing one of the jurors.
The juror was a young black man, about 20 years old. According to the news article, he had been arrested as a juvenile while riding in a car with a friend. The friend’s car was stopped by police who found a gun under the drivers seat. The case went to court, and adjudication was withheld, due to neither party having previous run ins with the law.
It is alleged that during the voir dire process (?) the young man was asked if he had ever been arrested and served time in jail or prison, he answered no.
So after a mistrial was called, a warrant was issued for the arrest of the young man who was charged with perjury as a result of his answer during voir dire.
The article went on to say it was suspected by the prosecution the young man had been paid by associates of the drug lords to throw the case which was later proven not to be true.
The article not only mentioned the name and address of the young man, but also the names and address of his parents. Worse than that, a “SWAT TEAM” (not exactly sure what they were called) set up and secured a five mile perimeter of his parents home in search of the young man, eventually going to the home of the juror’s parents. As a result of their actions, the young man’s father had a heart attack.
Although the names of the other jury members were not leaked to the press, the name of this young jury, as well as his parents were.
That sounds like a regular trial jury and the perjury charge appears to have been unwarranted because he was not convicted of a crime and probably had a good faith belief that the case was dismissed and the matter cleared off his record.
The prosecution’s reaction was ridiculously over the top and unjustified IMO.
BTW, he should not have been charged with possession of the weapon because it was not in his car and it was under the driver’s seat and not in plain view. Knowledge and intent to exercise dominion and control over the gun are necessary elements of a possession charge.

Professor, like you, I never once thought McCollough would ever have the evidence presented to the GJ released after they made a decision.
If he was speaking in good faith, he would have had the murderer arrested, booked, and released once he made bail, to present at trial. And should have done this by the end of August. To be transparent after the fact, serves only to keep the flames burning.
STL officials certainly have a lot to hide. What a tangled web they have woven to protect a cop they should indict.
