    Very impressed with Judge Nelson for listening , being attentive for so long. Her ruling was short , simple and quite understandable.

    I began watching when George said he would waive a pre-trial SYG, but basically most of today’s hearing was about financial payments and not George. That’s not good for George.
    As a laymen I’m thinking ‘these guys are arguing over how much money they should get, the hell with George”

    BDLR’s performance today was just a breathtaking onslaught. If a lawyer like West could not absorb the kind of pressure coming from BDLR, imagine what will happen to a mediocre like GZ. I find it amazing that the defense turned a hearing for reimbursement into a public inquest into- and against the defense. I am sure Beavis and Butthead would have performed better than West and O’Mara today. And West provided a big window into the inner workings of the defense and talked about stuff discussed between himself and O’Mara – stuff that normally remain secret (and definitely privileged!). I guess Judge Nelson enjoyed every aspect of that public duel and allowed the it to go on (may God bless her) . Overall this is a very bad day for the defense – especially from the PR point of view. BDLR nailed West over and over again. I hope DeeDee and W#9 watched this and took solace in the fact that this Tiger called BDLR was able to take vengeance for them – especially against Mr. West. I will be having a nice dinner today. No kidding. This stuff today is just unbelievable. I must be dreaming!

    TY folks for for the play by play of the hearing…..OFF TOPIC but i did enter the PBA50 national tourney and have to go bowl 8 more games today if i can, the 8 games yesterday really taxed my body and my performance was pathetic, but in my first try at the pro tour i am NOT in last place…..only one of 8 games was over 200 yesterday but is was a decent 242 at least.

        Occasionally I check. Her last blog article so far:One Year Anniversary of George Zimmerman’s Arrest I don’t have much time to check her forum though, she is quite active there too. But on her blog this commemoration was the last thing she did on Fogen.

        Strictly she already called judge Nelson prejudiced pro defense, and she would have much fodder to continue the theme now.

      IMO, O’Mara is still conning them. Florida law does not provide for a jury to decide on immunity. Jury instructions don’t provide for that either.

    i think the implication regarding GPS records being of a quality proving “they went thataway” was just revealed to be a fiction.

    In other words, my take-away is that the GPS records for TM are such that it’s only going to show he was in the general vicinity of a few cell towers, maybe not even three.

    It would take three to triangulate a semi-precise position.

    MOM tried to make a point about a report (complete with a map of where the CELL TOWERS WERE – not where TM was) that he feels he received after a delay. He tried to sneak in the implication that this somehow “proves” TM’s route from 7Eleven to the RATL was not as direct as one would think. What, if anything exculpatory could be made from that is beyond me.

    As near as I can tell, he was criminally profiled when he was already “near the clubhouse now,” since whatever happened before that isn’t prove-able or seemingly important.

      He did not hear him there was a coordinate obtained, just that he noticed that the call was served from a further away tower than the closest one indicating, on the sly, that Trayvon was not where the State says he was….

      weak, pathetic argument as cell traffic has variables to where it is served from (overflow, simultaneous signaling, upgrades, etc)

        Whatever it was that the defense was alluding to, it seemed weak. Obviously we don’t yet know what GPS info is out there and what it will tell us, if anything, about “they went thataway,” but if that’s the best he’s got then it’s awfully weak and awfully inconclusive and awfully vague.

      That was irritating as all get out. It appeared to me as if West was trying to conflate the cell tower records with the specious allegation they’ve been putting forth about the jewelry/screw driver.

      As if, by virtue of these separate incidents, months apart, in different cities, indicates that if Trayvon didn’t go straight from the store to his home, he must necessarily have been involved in some criminal activity. It was disgraceful. That’s how I heard it, and you can bet that’s how their donors and supporters heard it. Watch for that allegation to be one of the prominent talking points to deflect away from the fact that fogen waived the pre-trial immunity hearing.

      Oh I’m sure Trayvon’s ping records (but wait a minute — if that was not Trayvon’s phone then maybe those ping records belonged to some other suspicious guy?) indicate that he was somewhere Fogen did not agree he should be at some time that Fogen did not want him to be there, which is major evidence of criminal activity on the part of “the suspect” who saw “the gun” and who asked, with criminal intent, “You got a fuckin’ problem homie?” dahn da dahn dahnnnnnn… PING “!”

    You could call this a judicial smackdown and she did it politely leaving no basis for a motion to recuse.

    Does this mean there is no cleaned up tape for either the screams or W8 interview (very strange ABC only kept the 5min section they posted), and no other GPS data for the phones other than what, if any, has already been disclosed. If the case, I never held my breath, at least on the GPS data being available and usable from my personal experience tracking vulnerable adults, but it will be a disappointment for those who did.

IMO, and my prediction would be, that even if prosecution can’t clean it enough so that every word, phrase, scream is perfectly audible and or distinguishable, the fact there are two voices, one with GZ’s ineffectual calls of “Help me” (the only sound he has ever claimed to have made) and the other voice is screaming at full lung, that should be sufficient to show that at least one of them must be Trayvon as unless a ventriloquist you can’t do both at the same time. So either the “help mes” are GZ’s or the screams… both are physically impossible.

      The DeeDee interview apparently (from West’s testimony) had a version that was slightly better than the original provided, but I’m still not really clear on where they got that from since ABC only had the 5 mins.

        I think Bernie made a really good point. Could it be that the city hall, if I recall correctly, where Tracy heard it the second time had a much better system, better loudspeakers? That’s not exactly how he said but pretty close. Very, very good point.

        Now imagine. Tracy had said at that point: That was a much better copy. Had any of them immediately thought about the better system, the better volume? So they are trying to make hearsay a central issue?

        That was the original copy on Crump#s phone that he had to hand over to FDLE on Nelson’s order. The prosecution obviously gave them what they had. And strictly, I am a bit suspicious about all this hard-to-understand-caprioles around DeeDee’s interviews. I’ve made the same argument over and over again, e.g. at Talkleft. If I as a foreigner seem to have less problems to understand DeeDee but Americans like O’Mara and West, then I do have a problem with the argument.

        You know what my impression is, the audio would only be satisfactorily clear if “if they could hear “something on it they want to hear”, and as long as they cannot hear that, it is hard to understand..

        They filed a motion demanding ABC handed them everything they had. ABC told them, they would release everything they had. Which they did.

        Could it be, either Matt Gutman or his colleague realized that Crump was having problems with his recording or his cell phone and thus recorded the passage in which he shifted phones? They can ask them? No? Now maybe that copy wasn’t so brilliant either but it was slightly improved by the specialists in ABC?`Now lean back and imagine, the two–West & O’Mara– had spent some of the money on an audio engineer to enhance the tape instead of on lavish living and security expenses, state of the art case management programs? At what time would they have had a “better copy”? Probably several month earlier.

        The problem is they do not really want to spend too much money on something they already have, they prefer to dig for something they suspect is hidden from them. That’s the clear outcome of the basic ideology Fogen should never have been forced to stand trial to start with.

      Well announcing that they’re going to have a “major evidentiary hearing before trial” is ridiculous. They can’t just decide to hold a “major evidentiary hearing.” This whole charade was designed to make the Fogenites think that there is some terrible thing being done to the defense to railroad an innocent Afro-Peruvian. They will never be able to accept the fact that he was just convicted for a crime. That’s for — underdogs. Not for his exalted kind of people. Especially not for his “self-exalted” kind of people.

        I did catch that West snuck in a reference to information regarding Trayvon’s “criminal record.” BDLR was able to get a question in asking about the school board, in deposition, explaining that whatever Trayvon had did not meet their definition of a “weapon.”

        The judge reined them in before they got any further afield on that one.

        But, taking that into consideration, as well as seven to eight hours of deposition with various family members, it does look like the defense is still intending to discredit the victim in any way possible.

        Is the purpose of an evidenciary hearing to determine what can and cannot be considered admissable?

        lurker, always keep in mind that the Prof taught us, that every smear tactics they will try against the family or Trayvon opens the valve of character evidence from prosecution concerning Fogen.

        But I am very, very thankful to Bernie, I will call him that from now on, not BDLR anymore, that he let us know that they in fact deposed Sybrina Fulton 7 hours, if I remember correctly. Now imagine this. What relevant evidence concerning the crime could Sybrina possibly have.

        I am realizing more and more that the Professor was right from the very start and I was being too pessimist.

        I would love to see the questions the defense will demand the jury members are asked. I really would.

    Therefore, there is no prejudice to the defense and no basis for sanctions.

    The defense cannot delay or refuse to investigate the case and later seek sanctions after they obtain information.

    The motion for sanctions for “concealing” the admission about the non-hospital visit is ridiculous and the information in any event is not material or relevant and probably inadmissible.

      Considering the rapid weight gain, I wouldn’t be surprised if some other health issue is cropping up. I mean he went from lets say average to rail thin to the hindenberg like that.

        It looks, too, as if he may be on heavy, heavy doses of antidepressant medication, Rayven. That socks on weight in massive amounts, it’s known. The heavier the dosage, the more weight goes on. Coupled with is half-day incarcerations, his fears of going outside, and anxieties of the case (compulsive eating), these have probably contributed to his huge weight gain. He has to be on heavy medications–IMO.

        Does anyone happen to know whether inmates are allowed to have antidepressant medications once they are incarcerated?

        Absolutely, He is prevaricating. There is a reason why an a SYG hearing happens before trial. They only little bit he uses in his argument that there are no clearly defined time limits by the only motion that is still open to him. The first he waived himself. He only could have done that at arraignment.

      He doesn’t want the donors/supporters to hear the words coming out of fogen’s mouth. It’s as if he doen’t realise that we’ll fnd out anyway – even if it’s only by the fact that there’s never an immunity hearing scedule before 6/10.

      Tomorrow is 5/1. If he’s going to calendar it, it would have to be in the next week or so.

        absolutely. Debra Nelson, has clearly recognized that by now. Good decision to deal with the money motions post trial. Obviously they would only use it against her, if she does not agree with them. Making their fan base shout prejudice. She didn’t seem convinced, and Bernie was really, really good.       I think O’ara is trying to split hairs on whether it will be “pre-trial” or “during” trial. If O’Mara let’s him waive it will only be “pre-trial”. This is exactly what the prosecution wants clarified, and O’Mara is tiptoeing around.

      Xena, MOM & West are like the Odd Couple. MOM is such a friggen Drama Queen, so high strung, whiney, and strident. And then there’s West, whose voice is several registers lower, painfully slow in making his points, and puts everyone to sleep. The two of them are so extreme in their styles that there’s no middle ground: no steady, even-tempered, effective attorney who is able to articulate points quickly. JMO, but the two of them leave a huge hole in the middle, as per the impression of any competent representation.
