Chief Justice Roy Moore of the Alabama Supreme Court is a disgrace

Chief Justice Roy Moore of the Alabama Supreme Court is a disgrace to the robe he wears. Today he signed a four-page administrative order directing state probate judges to refuse to issue same-sex marriages despite the US Supreme Court’s decision in June in Obergefell v. Hodges, 135 S.Ct. 2071 (2015).

His rationale is that Obergefel only applies to Ohio and the other three states whose statutes the Court considered in deciding that the statutory ban on same-sex marriage violates the Equal Protection Clause of the Fourteenth Amendment. Therefore, he concludes that Alabama’s similar statute survived Obergefel and the Alabama probate judges would be violating Alabama’s statute, if they grant a marriage license to a same-sex couple.

His argument is absurd because it violates the Supremacy Clause. He cannot possibly be so stupid or ignorant not to know that.

Therefore, he should be impeached

    I live in the South and many people here have the “It’s my way or the highway attitude”. They actually believe they have the right to interfere in your personal life, judge you, deny you your civil rights based on their religious and personal beliefs many people keep their politics and beliefs to themselves for fear of being shunned or even physically attacked, many LGBT still pretend to be straight (even get married) or stay in the closet. It’s sad to see how far behind we still are.

    What is the impeachment process for a Justice of the Supreme Court in Alabama? Who could start that ball rolling? Because the LGBT community is pretty savvy and if there’s an impeachment available I’d love to see it get started. One thing, though: what is the history of this guy? If he has been on the Supreme Court Bench for a while, presumably he started out on some lesser bench where he made decisions that never got publicity. I’d love to find out how many people he has railroaded, how much illegal stuff he has done, whose lives he has destroyed.

    I heard a state circuit court judge say that a constitutional argument brought up before him was irrelevant because, “The Constitution, that’s federal; this here’s a state court.”

    I also saw a commanding officer (of the marksmanship unit of Fort Benning, Georgia) get a policeman fired because the police officer, on his own time, had accepted a job, perfectly legally, of providing protection to a mother who was going onto the base to pick up her children from visitation with their father, who was a colonel in the marksmanship unit there. The commanding officer of this Army Unit had the police officer fired for “contempt of the U.S. Code on an army base,” a charge that does not exist.
