SCOTUS rules that the right to same-sex marriage is protected by the Fourteenth Amendment

The Supreme Court of the United States (SCOTUS) held today by a vote of 5-4 that same sex couples have the same right to get married as opposite sex couples. Their right to do so is protected by the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution. Justice Anthony Kennedy wrote the majority opinion joined by Breyer, Ginsburg, Sotomayor and Kagan. Roberts, Scalia, Thomas and Alito dissented.

On this same date in 2003, the SCOTUS struck down a Texas law criminalizing sex between two people belonging to the same sex and also on this same date in 2013, the SCOTUS dismissed an appeal over same-sex marriage on jurisdictional grounds clearing the way for same-sex marriages in California to resume.

    @girlp: You are right! The right wing extremists heads are exploding! I read a few of the comments on AOL and FB. They are losing their collective minds! LOL! LOL!. You should also read their comments about the President who is in my mom’s town of Charleston, SC for the funeral of the State Senator who was murdered in his church! A bunch of hypocrites they all are. They are so twisted and so full of hate. They don’t want or like the changes that are transpiring but too damn bad. The world is no longer made up of white men. Everyone in this country has rights and they need to get used to it!

      Their idealogy and religious extremism ties them to their base and SCOTUS took two issues away from them not a lot they can do but have temper tantrums. They hate anything Obama does if he sneezes it’s wrong. Seems lately we are finding out more and more how racist and what hypocrites they are; hopefully their reign will be over soon that is if the courts will stop the gerrymandering and the attacks on voter rights.

      It seems pretty stupid to blame President Obama for the same sex marriage decision. It wasn’t his decision to make. But in their minds, I guess anything that happens that they don’t like is his fault.

      • Yes, they are irrational, obsessed and stupid. They hate him because he is black even though every human on the planet can trace their roots back to Africa. Our species, homo sapiens, originated in Africa 200,000 to 300,000 years ago. We are all related to each other.

    Professor, I’m sorry to go OT but I wanted to ask you this question:

    SC Governor Nikki Haley announced that “we” are going to want the death penalty for suspect Dylann Storm Roof. Isn’t that a violation of the constitutional mandate for separation of powers? She’s part of the executive branch; aren’t guilt and punishment in the province of the judicial branch?

    • No, I don’t think so. Determining guilt and punishment is a function of the judiciary, but filing charges, including seeking the death penalty, is a function of the executive branch. I understand your concern, however. She should call for justice to be done, but calling for the death penalty before a trial has occurred is a little too close to creating a mob mentality. Understandable in the passion of the moment for an individual, but inappropriate for a public official, especially the governor who supposedly speaks for everyone.

      She has to be careful to avoid poisoning the jury pool.

The racists and bigots are on there too, making disparaging comments about our President. They are so laughable.
