We will be live blogging the Michael Dunn trial today and watching the proceedings via live stream link at First Coast News.

We are in the defense case.
Defense has possibly 2 more witnesses to call:
Doctor John Abuso, who is supposedly an expert regarding reactions by juveniles to extremely stressful situations, and possibly the defendant.
Here’s my take on Dr. Abus, who would presumably testify that fleeing from a shooting scene and ordering a pizza after attempting to kill four teenagers in an SUV is a normal human reaction (H/T to Lurker for the snarky remark):

Where he went to school to obtain his degree is not listed.

I am not seeing any evidence of a scientific or medical basis to what this man does.
By almost any standard that I can imagine, this guy is not qualified to express a science or medical based opinion regarding any matter in this case. Therefore, his testimony should be excluded under Rule 702 as not helpful to the jury to decide an issue of that nature in this case.
Because there is no evidence of self-defense admitted into evidence, I do not believe Judge Healey will give a self-defense instruction unless Dunn testifies.

Horribile dictu, I have run into people like Dunn many times in my life. They do something that not only they, but EVERYONE recognizes as completely wrong, utterly malevolent and completely forbidden by civilized society, and then they immediately adopt the “victim” position and carry on about how they have been mistreated and especially by being blamed for what they undeniably SHOULD be blamed for. Their injured innocence becomes the whole story, and now, to them, it is somewhere between immoral and obscene to even discuss what they DID. Discussing what they DID becomes the blameworthy behavior. The establishment of this height-of-wrongheadedness within an instant after their crime is accomplished by the seamless assumption, by them, of inviolate and permanent “JUDGESHIP.”
THEY judge what everybody ELSE has done, so judging THEIR conduct is taboo.
Unfortunately, when you run into someone like that in a work environment or in a family, so that you cannot get away from them, they can distort and even practically ruin your life. If you run into them in a parking lot they can kill you. I wish I had coined a name for such … humans.

Having flown myself and having flown with my dad, who had a small plane lic. many times, Duhhnnn said he did some stunt flying somewhere in a high wing small plane, which cannot be done safely.
Those type of plane have near 0 lift when the wings are upside down as they don’t have enough horsepower to provide enough forward thrust to overcome it.
So TO, he’d have to be well above average, like Superman or the like.

racerrodig, I would be more inclined to think what he considered acrobatics is the controlled stalls that we were required to learn before we took the flight tests… I seem to recall that the a/c that he was flying (his father’s) was a 172 and you darn sure were not going to do any advanced moves in it… IMO
Absolutely correct. Passing a flight test does not constitute stunt flying.
Stunt flying needs about 200 mph as a minimum for most stunts.

racerrodig, To add just a few more thoughts about his flying. I would suspect he is not IFR rated, nor has the endorsements (rated) for either high performance or complex aircraft. You know darn sure he would have high lighted those qualifications had he possessed them… Did you catch what his alleged instructor said, when they flew to lunch or breakfasts, Done Dunn often “went” with them, not he often flew them to the events… I really think the acquiring the license might have been one of the few successful events in his failed life…
bettykath, There were (are) some Cessna 152’s that were modified with shorter wings and up to 150 hp that were (are) that were capable of some limited acrobatics, the key word is “limited” and I don’t think that Done Dunn was qualified (per his lack of bragging) to fly one of those by himself…. but that is simply my opinion and as such means very little…
The airplane he was flying when he violated restricted airspace was a 1946 Aeronca Champ. I don’t know if that is his plane or he was moving it for someone.

I never checked the tail number to see who it belonged to probably because it really did not interest me at the time…

Dunn referred to a “pop” that is heard on the gas station surveillance video before he started firing. When pressed, he said that he never heard anything that sounded like rifle fire.
I’m no expert in this case but I think the forensics simply prove that the truck was moving when Dunn shot at it after the first shot – the angles are progressive.

I think Rhonda is praying that Dunn goes to prison so she can get away from him. I think she is silently terrified of the killer. Hence the no he never said anything about a gun, the neighbor called us. Dunn constantly makes Rhonda sound party to the killing but I believe she was/is terrified of him. Ignorant as it may sound that’s what I think.
I don’t think that sounds ignorant at all, and I think that theory is a distinct possiblity, disappointed.

This is his fiance, and this is absolutely devastating to what he just testified to: that there was a shotgun and four shooters.

Yes, and as it turns out, in response to prior questions from Liza and blushedbrown, holding back the Rouer gun testimony until rebuttal was strategy, to force Dunn to take the stand. And, they just blew him up.

I don’t think he ever threaten her or mistreated her. I think IMO that she knew what he did was wrong, he didn’t even try to justify to her at the hotel, or the drive home that he was in the right sorta speak. IMO she felt that she should tell the truth and nothing but the truth, because that is what a normal person does. I think the crying is for the victims not for him or her. That somebody died because of him. She even stated in her police video that she thought, but did not say to him. “What were you thinking you asshole!?” or something to that effect. But anywho just my thoughts………………
Dunn said she doesn’t understand self defense. If self defense means shooting up an SUV full of kids because you don’t like their music, then I guess I don’t either.
She also said that his incoming call from his neighbor was on speaker and she said Michael Dunn said nothing about the murder or needing to talk with the “law enforcement” (aka Agricultural Department) about “something important” as he had testified.

Loved her last answer to Stollo– she was being careful to get it right, not first thinking to be careful to answer in the smartest way for her man by agreeing confidently ‘yes’.
She said something like ‘I suppose so’.

Rhonda sought counseling, but she didn’t call 9-1-1.
She stated in her interview, her confidently given, non upset police interview, that she didn’t want to confront Dunn after the incident and while driving to the hotel, as she didn’t want to say what was on her mind, which was ‘What were you thinking?!!” (about shooting)

So why didn’t you call the police when you were safe in the hotel? He thought he was safe from getting arrested and didn’t bet on a customer getting his plate. I bet he would’ve sold the car too if he hadn’t been caught.

And about driving into the parking spot next to the durango, the music WAS ON really loud, remember the eye-witness who is on the store video, the general contractor stopping for a fountain drink who didn’t choose to park in that spot because of the same Durango’s loud music?

This is off top of my head as I watch the trial right now. I’m going to go back over eye witness accounts, dowels, and ME report to confirm that he was in fact sitting in the car when killed.
Dunn put it out there that door could have closed when they backed up. Door lock issue, evidence says no child locks on and Leland says Davis went for the handle and tried to open the door but didn’t. There is something about Leland’s testimony. There were inconsistencies in the boys’ stories as there should be.
Let me also add and those that remember me from discussion during Fogen’s trial will remember me saying this…”claiming you are in fear of your life” is what LEO are trained to say on the stand. It’s an immunity that we provide LE. I once heard maybe a professor say this, “all you have to do is say you were in fear for your life. As an officer you better not shoot unless you are damn sure your life is in danger.”
We trust police for the most part and we give them the benefit of the doubt. Other officers give them the benefit. Not often will anyone let alone LEO admit that they made a mistake…That what they saw was not actually what they saw. We can watch Marshalls in simulated training when they are given a target and scenario and have to make split decisions that are life and death. Interesting stuff.
Point is that we now have relaxed that standard through SYG laws and what not. Self defense for citizens has always been a defense. Your home and your car (castle doctrine). Dunn is no experienced gun owner that is versed in self defense laws but he’s asserting himself to be.
If I carried a gun and was a responsible gun owner who knows how to operate it safely and I carry it on me or in my car…I would want a jury to believe me if I had to protect myself. How do you prove whether someone is in fear? I don’t know the answers to these types of things. What if Dunn admitted I thought I saw a gun and I now realize there was not one and I’m sorry ? I thought I was in danger and in the moment I had to make a split decision under the circumstances and was actually in sound mind.
What and how do we decide going forward who is in fear for his/her life?

I think he is getting a little better now, but he let him talk a little too much about placing a weapon in the hands of Jordon Davis. I truly hope this jury took good notes and remember that no weapon was found.
Honest question that I don’t know the answer to….evidence suggests no weapon…I’m able to convince my fellow jurors that and we all agree that there was no weapon.
He thinks he saw one. Seeing a gun is key to his self defense because he admits on direct exactly when he felt in fear. He says he wasn’t in fear during confrontation only when he saw and heard barrel hit the door.
So if I know there was no gun but Dunn thinks there was and I look back at testimony is it possible Dunn thought something else was a gun? Yes, if I believe his testimony out of his mouth.
Let’s say I know he saw nothing and thats what I’m going into the jury room with. I have to convince people that Dunn just went nuts for no reasonable reason. I have to believe the worst about someone…..he just went nuts, he didn’t experience any fear and if he did he went cook coo.

Jurors are weird in Florida. I think they can’t go on the possibility that “if ” this or if that, he fired multiple shots. He left the scene. etc etc.

If he got out, even though not one witness said they saw anyone out of the vehicle, he would have had to back up and close the door to advance forward. Even a tiny guy wouldn’t have the space to go around the door, which had to be closed after JD got back in and Dunn fired. Juror 82 is a doctor. This expert hopeful is not going to fly, I really don’t think a doctor will be convinced.
Let’s not get too hopeful about doctors. I have a friend who is a highly qualified physician and was in a high-ranked position in the Public Health Service for many years. Excellent diagnostician! She started blogging in the Fogen trial saying that, basically, Fogen was innocent because lots of Blacks kill whites. Her stuff was just plain ignorant-plus-stupid-plus-racist-and-offensive. I couldn’t even answer her and haven’t spoken to her since. She blogged about this 17-year-old Black murderer who had beaten some eighty-year-old couple somewhere in Mississippi I think. What the hell that had to do with Trayvon Martin I failed to see. Yet this woman could diagnose a tumor as big as a thimble in a person with five different ailments in under ten minutes, and be right on the money. Doctors can be convinced by bullshit same as anybody else. Unfortunately.

I’ll answer here, Fred talking. He has a right to testify, for one, and he really has no choice but to testify, because so far, there is no evidence in the record to justify a self-defense jury instruction.
Every defendant in a criminal case has a right to testify or remain silent in his own case.
As a practical matter, Dunn must testify or he won’t get a self-defense instruction.
Why?
At this point, no evidence of self-defense has been admitted into evidence. He has to testify that he shot in self-defense or he does not get the instruction.
Then it will be up to the jury to decide whether to believe him.

Judge Healey had his coffee this morning. He asked whether acute stress response is in DSM IV and V.
Healey is explaining why he is not going to allow Dr. Abuso to testify.

Even if acute stress response is in the DSM-IV, it is beyond his scope to even diagnose that condition.
He’s a minister in counseling psychology – wonderful for his patients, not likely good for expert testimony for trial purposes.
Maybe someone could ask him what personality traits he might expect in someone who has been married multiple times and is looking forward to his 3rd (or is it 4th) marriage.

This doesn’t have anything to do with the shooting itself and it’s only a possible explanation for Dunn’s failure to call 911.

Nobody took Dunn’s blood pressure, heart rate, respirations, checked his pupils to even verify that an ‘adrenaline dump’ ever occurred.
Even in a very worse case scenario- the dog ends up at a shelter, and even if it is a kill shelter, nobody would euthanize the dog, for seven days. Animal Control is a branch of the sheriff here, and I believe there would be efforts to get the dog back into a home, before killing it. So, that excuse doesn’t fly.
If they cared so much about the dog they would have skipped the shooting, and gone to the dog.

I am guessing that 1. they thought there was a possibility that nobody got a plate number and 2. he had at least 3 drinks in him–regardless of how well he carried himself. Yes, and in fact without the homeless guy on probation giving an accurate plate number, he may have gotten away. My nephew was murdered in 1985, a double murder, and it remains unsolved, to this day. Whoever it was, literally got away with murdering two high school kids. It happens a lot, and I think Michael Dunn was hoping for this.

What I found interesting is that the list I read didn’t differentiate between those who were on the main jurors and who were the alternates.
What I found interesting is none of the three black females on the jury had children nor were they married.

Yes, but didn’t Miss Rhonda already explain to the folks that the pizza was for her, to make her tummy feel better, and she was the one worried about the pup? She was very clear that Dunn was just taking care of his loved ones, her and the pup. Afterwards he fully intended to turn himself in for the attempted massacre.
Not gonna fly. It’s bizarre.

I think that she knows how badly it would look for her to lose this one. And in this case, there are a number of direct eye witnesses, not people who knew the defendent peeping out from behind curtains and such.
I think the main thing is that they were actively trying to lose the Zimmerman trial because they did not want to expose the incompetence and racism of the Sanford PD and the district attorney’s office who at first refused to charge zimmerman
Or, third possibility, they want to win in this trial as much as they wanted to lose in Fogen’s.
The issue is whether this guy’s testimony would be helpful to the jury to decide an issue in the case.
He is not an expert on self-defense.

Strolla, aka Thunderpuppy, is going to try and use this guy to justify that after the shooting, Dunn was under so much stress that he walked the dog and ordered pizza, but he was incapable of calling 911. Or something.

Well now, if that flies, then I think I’ll go take care of business in a little place and do my thing and then walk a dog and order pizza my damn-self. I can think of a few … well, nuff sed.
The expert hopeful is actually more of a chaplain. He seems like a nice enough guy, but he was a prison chaplain, which has nothing to do with Dunn’s physiology on the night of the incident.
Yesterday the ended the day working on jury instructions. Since Michael Dunn had not shown enough evidence to earn a self-defense jury instruction, we believe he may testify.
There was also a request from Strolla to present an ‘expert’ in ‘fight or flight response.’ This has to do with physiology, but nobody took Dunn’s vital signs during the incident, so this seems an endeavor into junk science.
Hee hee. He fought and then fled. If you can call putting a lotta bullets in a car full of teenagers a fight, that is.
Right. It’s absurd.
