Good morning:

Court will resume this morning at 9 am EDT with Mark O’Mara’s cross examination of Chris Serino, the man who was in charge of the Sanford Police Department’s investigation of the Trayvon Martin homicide.

Court recessed for the day yesterday after Serino admitted that he believed George Zimmerman was telling the truth.

    Just a reminder that TM’s dna was ruled out as possible contributing to any dna found on GZ’s gun. They found GZ’s dna and an unknown sample, possibly Tim Smith who handled the gun on the scene. But Trayvon was ruled out so bam! Thanks Osterman.

    My cousins funeral will be Friday. Here all the time I thought he passed away in New Mexico and instead he was in Tijuana Mexico at the time. They had a hard time getting him back to the States. *sigh*

    1. He admits to following which make him the aggressor. 2. GZ claims he got out of his truck to get an address and says he told dispatch to meet him at the truck.

    I don’t understand what was the State’s move with this guy either. They didn’t need MO to testify to GZ having “wrist control” of Trayvon because Georgie already explained that to spd in one of the interviews.

    They didn’t show the atm video to show MO was at the scene (if it was him)… so where are we going.

    Now we have MO claiming that Trayvon was looking into a lit window… maybe the clan read the comment here the other day about how could Trayvon be looking into windows without a torch!

    Soooo soooo suspicious all this!

            Racer, sorry to trouble but my for some unknown reason my ip address is apparently being flagged up as spam by the spam guard so for the past two days any comments I make unless replying to a blogger’s reply to me on the notifications page they do not register on the page.

            According to WP the owner of the blog has to approve (accept) at least one of my comments in the spam box and I will be free. It worked on Xena’s so she knows what to do. Xena, Faux, Cielo I think they’ve all emailed the professor to no avail.

            You may not get this and it may not work either but I am posting to as many as bloggers I can because if you all reply to any of the professor’s or Cranes’s posts with my plight I could be vocal again.

        In his book Osterman said Trayvon grabbed the gun between the rear sight and the trigger guard. I hope Bernie brings that up. This was a huge point on HP last year. I believe you were in on that.

      Burying Zimmerman in his own lies. Most important points 1. Saw TM 15 feet down that path(saw him with flashlight and followed and was not ambushed) 2. Was knocked backwards (contradicts evidence)
      3. TM GOT UP AND MOVED (Fail, super fail and triple fail as all witnesses never saw them change positions.)

      The admission of the wrist lock was in the interview just prior to the voice stress test. Apparently Bernie didn’t want to enter that video b/c it’s about a test that’s inadmissible. Although I would think that the tape could be edited, by agreement, to keep the part about the vst out. Don’t see MOM agreeing with that.

        Yes, it could be but as you say State could, and imo should, have agreed to edit the tape because what MO says GZ says just cannot compare with what GZ said himself. Furthermore stress tests are not valid in court so JN could have instructed jury about that, but leaving out that tape they have missed other really good things from it, such as how GZ shoots, and a few other gems. Not sure was a good move.

      Osterphuck proves Zimmerman confronted Martin. If he saw him down.that sidewalk 15 feet away then he went 15 down there to confront him OTHERWISE HE WOULDN’T HAVE BEEN DOWN THERE. Also proves Zimmerman lied about being knocked BACKWARDS, TM did not sneak up on him and he would have had plenty of time to run for his truck or call police if Martin waa 15 feet away.

  98. The sickness of adults engaging in the coverup of the murder of someone’s innocent child from the witnesses to the people in charge of law enforcement and the media. It’s really a testament of the status under which blacks exist in the country. The pretense that there is no racism and yet the obvious guilt(yes its obvious) of the defendant is still something they try to hide in an effort to prevent him from being punished for killing an innocent black child. This is killing me, I really don’t expect a conviction, but this isn’t the only time. Aiyanna Stanley Jones, you will never be forgotten by me either.

      The pretense of a person speaking nicely equating to an incapability of harboring ill feelings or murderous ideations, is one tenant of racial bigotry. This person speaks calmly and nicely, so he is better than his victim, who happens to be an African American kid.

      Then they wonder what is wrong. There is no presumption of innocence, no benefit of the doubt, which is shown to not have been afforded Trayvon but, fogen? Yes, he must have been the assailed one. Happens all the time in all manner of interactions from work on down. This attitude has been ingrained in the shaping of this country and continues today just in more elegant and descriptive terms than before.

      Those were not butterflies. They were knuckle bandages–designed to apply a bandage with sticky tabs on both sides of the joint. Not on a head.

      And butterflies are used to pull together the edges of a laceration without sticking in the middle–no bandage material to absorb fluids, or anything that might get stuck in the healing process.

      The wounds on the front were not lacs, but abrasions.

      To my mind, those bandages were strictly theatrical. The nose wound had already scabbed over–no need to keep out possible infection. And if there was a concern for scalp infection, they might have shaved the spot even closer. Hair is not known for being antiseptic.

        Bandages were optional. In fact, bandages get wet from sweat or showering and can breed bacteria and fungi, infecting the wound further. Best to wash lightly w/soap & water, dab dry w/clean towel (preferably paper).

        In this case, they were décor.

        Only appropriate size bandages would be Johnson & Johnson child-size Band-Aids (“Hello Kitty” Band-Aids most popular.)

          TSTAS, sorry to trouble but my for some unknown reason my ip address is apparently being flagged up as spam by the spam guard so for the past two days any comments I make unless replying to a blogger’s reply to me on the notifications page they do not register on the page.

      I feel sorry for Serino. I think that he would have been impartial with the investigation, but he had pressures just as he has pressures now to keep his mouth shut. On 2.29.12 he did not have enough evidence to challenge CAC on the inconsistencies yet. I think that he was getting pressures from those that know he was wrong and from those trying to protect the loser at life.

      I also feel that he has been under self turmoil about being pulled into this by the killer of a “skinny kid” by a grown man trying to be a cop but failed in every way.

      I know that some may not agree with me, but I feel sorry for everyone affected by this, even the hateful racist folks that lash out against Trayvon and his family. This senseless murder has had a strong impact on a ton of people whether for or against the murderer and sadly, he just is not worth it – he will never be worth much of anything to anybody. He even put his wife in a position where she is facing a charge so he cares nothing about her either. His brother has displayed displeasure for young Black men and boys, his father has cursed the entire Black race and his mother does have the ability to reign them all in.

      The way this case has consumed my every waking hours is terrible. Yesterday, someone put a link on my FB page that led me to a site with horrible pictures of Trayvon’s dead body and I literally screamed out in pain tears flowing (the title of the page deceived me). I intentionally avoided the pictures because I did not want to see them.

      I feel sorry for everyone except for the lumpy lump CAC for putting all of us in the state we are in today.

      The defense team are some really sick puppies. Now trying to pin a slim jim found days later on Trayvon. They probably dusted it for prints and did not find Trayvon’s print on it not to mention that it was found after the fact. I would have hoped that someone looked in those bushes that night.         They basically hampered the prosecutions granted motion to compel testimony from Fogens’ professor. He had travel obligations and they didn’t show up for the scheduled interview and now the prof is gone. So the state was to interview him by video or submit the video they did from what i understand since it is the defense’s fault they missed it. JN will rule on it this afternoon after the state inquires to the professors’ schedule again to see if both prosecution and defense can interview him by video. The defense also indicated they may object to his testimony any way and they were just too busy working hard to deal with the prof interview.

    I am going to share a true story with you. Last month, the Saturday before the trial started, I attended an Irish Festival in the state I live in. It was at a horse race track. Horse racing was going on that day as well.

    After the festival, I decided to do a little betting on the horses. I am not much of a gambler, but it looked liked fun.

    I placed a $20 bet on a horse that had very long shots. In fact, this horse was not favored to win and was picked to come in last. I picked this horse to win, despite what others were saying, because I was inspired by the name of the horse.

    I have followed this case since last March. Like all of you, I have been appalled at such a miscarriage of justice. So I have waited for this trial to begin.

    When I saw the name of the horse, and two days before this trial began, I knew I could not lose.

    The name of the horse was….Skittles.

    He came in first. I won $160.00.

    I am still inspired. I believe we will win this trial.

          I think the IP addresses are calls by some app in the phone, automated, like checking or notifying that new mail has arrived. The IP shown would always be the last one before the phone itself; you can’t tell from that where the signal ended up. That’s why it’s a TMobile IP as it was their towers.

          Outgoing such calls could be someone sending emails with the phone. No times were recorded, so I imagine data is counted by megabyte, not by minutes.

            I use T-Mobile and e-mails and text messages show up on the Data usage, however I have noticed on my Blackberry (yes, I am an antique and still use one of them!) the only thing that shows the IP address in the phone call portion is when I use the Blackberry secure Message program, and then it shows the IP of the Blackberry server and no phone number. I also have a Galaxy III and I will admit, I can’t figure out the billing on it from T-Mobile, their billing process is rather strange at best….

        I have mixed feelings. Considering that GZ said he got on top of Trayvon after the gunshot and that he allegedly asked a witness to help restrain him, maybe the jury will believe Trayvon spoke.

        On the other hand, if Trayvon spoke and later was apparently not in need of being restrained, laying on his face in the rain, how is it that GZ and/or neighbor did not try to save Trayvon’s life with CPR or call for medical help?

        I would also know if GZ was there at the crime scene when the officer was giving CPR or his body was eventually covered by the officer when he realized Trayvon was dead.

      I don’t but I am afraid. As I said above, I am surprised by how others have an entirely different perspective of the same trial. Boggles my mind. So I do harbor fear that the jury could do the same.

      There is something that has always bothered me about footinmouth’s story about the shooting. He has stuck to his story that Trayvon said “you got me” or something to that effect. BUT….in his statements (all of them) he says that Tryavon saw the gun and was reaching for it and that is why he was in fear.

      Yet…in the reenactment, he says to the officers something like, “he said you got me. I wasn’t sure I shot him.” Then footinmouth says, and this is the part that gets me, “I felt like that is when he (Trayvon) knew there was a gun.” but he says that after Trayvon is shot.

      How can that be if Trayvon was reaching for it before you shot him, dips###? If he was reaching for it, he knew before you shot him, not after.

      I do think that was powerful, however, the jurors complained of not being able to hear very well AFTER all of the tapes were played so should we really believe they will thoroughly review those tapes? They don’t have to review everything single piece of evidence presented. It was another fail by the state to not make sure THE MOST IMPORTANT PART OF THEIR CASE was loud and clear to the jury or at least stop frequently to draw attention to certain parts and make sure the jury understood the evidence.

        Keep in mind that everything that gets introduced into evidence will go with the jury into the jury room when they deliberate. They will be able to play any tape as many times as they want. When they deliberate they get to examine all the evidence for as long as they want without the blathering defense trying to confuse them.
        That is why I am trying to pay close attention to the exhibits, and to the testimony of the witnesses. What O’Mara and West say will not be in that evidence box.

        I believe they’ll review it, with their undivided attention, possibly more than once and possibly even ask if a transcript is available, based on the commentary about how the jury’s attention was super-focused and not even taking notes during the playing of the tape. My impression was they thoroughly understood the importance of it.

      I talked to a co-worker this morning and she seemed more impressed by the videos than anything Serino and Singleton had to say. She paid very close attention to the questions and Zimmerman’s answers and could not believe they did not arrest him that day (during the challenge).

      I think its probable that at least some members of the jury only know Black people or even young people Tryvon’s age from tv. For example, one of the juror’s said she thought Trayvon shouldn’t have been out so late at night. There are MANY people who don’t think 7 is late. But its possible that a person of a certain mindset might agree with gz that certain people don’t need to be out after dark, and that they don’t personally know any reprsentative of this group.

      I am hoping the State will bring in medical experts to testify that with a hole blown through his lung, the lung would instantly start filling with blood. when any liquid or foreign object enters our respiratory tract the body is hard wired to react with spasms and coughing up what ever the substance was. If Trayvon had lived long enough to speak, he would have been choking on blood and spitting it right into Zimmerman’s face. The assertion that Trayvon simply sat up, politely raised his hands in surrender and spoke as if in injured is not physiologically possible.

    In my humble opinion, I think this case is going well. I do NOT for one second question the prosecutorial élan of BDLR, Guy and Mantei. These folks are the ultimate Sky-Hawks. And like all Sky-Hawks, they kill their prey neatly without leaving any mess behind. They may appear too nice and dignified. But in truth, they aren’t and no prosecutor is. Anyone who wants to hang you or take away your freedom for life ain’t “nice” or “dignified”. They will glean whatever is positive from SPD and stay out of the rest. Their goal is GZ, not the SPD and definitely not O’Mara and West. In some of our interactions and thought exchanges on other threads Professor described criminal trials as ‘trench warfare’. No other words can better describe adversarial litigations. I understand and respect the heart wrenching fear and concerns expressed by of a few of us up thread – given the history of our nation. There is fear amongst a significant minority group of our society. We all shear that fear. The stakes are very. In all trench-warfare you take in a pre-calculated number of casualties. There thus definitely will be painful days. But like all well planned wars where ALL the strength and weakness of the enemy is known and accounted for in the war plan and strategy, the outcome of the war is not in doubt. Within their trial strategy, Corey, BDLR, Guy and Mantei have made specific calculations. GZ’s strength and weaknesses haven been catalogued, assessed and weighed against irrefutable evidence and found seriously lacking – beyond reasonable doubt. That is why these Sky-Hawks are taking GZ head on by introducing ALL his statements and claim of self-defense and calling witnesses who are friendliest to him (G). It takes overwhelming prosecutorial confidence to do that – trust me. There is absolutely no reason to- or room for despair!

Dr. Leatherman was a professor of law and a famous defense attorney and I believe in his analysis over these talking heads any day of the week. Justice for Trayvon!

      A great general once said that good generals win first and then go to war, whereas unprepared generals go to war first and then try to win. I hope that is what’s going on here. And I also agree that despite what kind of spin the media is putting on it, it looks good for the prosecution. Everyone seems to be focused on the wrong thing. The so-called “challenge interview” is (IMO) what the jury is going to take into consideration very deeply. What Serino says he believed is tricky, but also very consistent with what he had to work with at the time. The State will eventually get the kudos, not SPD.

    Professor, I asked a question to someone on the last post about why footinmouth’s coworker’s statements about him acting as jeckyl and hyde cannot be brought in. The coworker said that footinmouth would snap, and once threw a woman and injured her foot.

    I think it was YAHTC said it could not be brought in because if is his past and not relevant.

    Why would it not be relevant? When the defense asked Serino about footinmouth’s demeanor and affect, did they open the door for it to come in by the State?

      The question and answer regarding GZ’s demeanor during the interrogation was limited to the interrogation only and is not enough to open the door for the State to introduce character evidence.

      However, Ms. Lauer testified as to GZ’s character. I think the State will be filing a Motion to introduce character evidence based on that.

            o’mara asked jenna lauer if she knew zimmerman to be a ‘hothead’ etc. from her experience with him at HOA meetings. judge instructed her she was subject to recall and still under subpoena. this was after a very involved sidebar because BDLR was asking outside of the jury if ms lauer was aware of the defendant’s previous legal scrapes and violence. should be interesting!

            Also, someone had stated prior on the post somewhere that OMara is making 2 points. 1. George Zimmerman cooperated fully and 2. He displayed no anger or hatred towards the boy. If they can bring his past behavior into evidence then it would be beneficial to the prosecution in possibly explaining away his actions and flat affect. He was calculated in that he did not want to give the appearance because he learned in the past it led to trouble. The flat affect and numbness, isnt that a tactic they use to try and beat polygraph tests?

            i think ‘flat affect’ is normal for gz and his psychological makeup and is compounded by his med load, although i am not qualified to diagnose.

      I believe there was a door opening to bring in some of Zimmerman’s past info, but not with Serino. Remember they talked about the domestic violence and battery on an officer. I think it was Jenna Lauer, though I may be mistake. The “interactions with others” question O’Mara asked last week. I remember there was an 8:30 hearing the next morning, but I go to have breakfast with my mom most mornings and didn’t see it.

      Perhaps someone can post how the judge ruled on that? I believe that’s one of the reasons Ms. Lauer was not released, but subject to recall.

      All that said, I don’t know that the *throwing the woman across the room* info can come in because there is no documentation? Maybe they can bring in the guy who said it, if they want to go that far. I think they’ll be satisfied with those interactions that have documentation from the police/court. There’s certainly enough of it. I believe there’s at least three (DV, Battery of LEO and road rage). Not with Serino though. I think they would have to recall Lauer.
