Prosecution crushes defense during third day of Zimmerman trial

Good afternoon:

Excellent day for the prosecution with two eyewitnesses, Jane Syrdika (W-18) and Ms. Manalo (W-13’s wife) identifying the shooter as George Zimmerman and “the boy” as the person who uttered the death shriek.

Ramona Rumphy returned to the stand to complete her testimony about the defendant’s five 911 calls over a six-month period complaining about black males whom he described as suspicious.

The next witness in the box was Rachel Jeantel (AKA: Dee Dee), a badly wounded emotional tower of strength who was determined to speak the truth, no matter how painful that might be. She could not stop trembling when she took the stand. She continued to tremble for more than an hour before she settled down. She testified that she has known Trayvon since they were in elementary school. She described their relationship as close friends who have never dated each other.

No surprises in her testimony regarding the substance, if not the form, of what they said to each other regarding his contact with the defendant. For example, she said Trayvon referred to the defendant as “a creepy ass cracker” who had been staring at him during the conversation as he sheltered from the rain in the mailbox area adjacent to the clubhouse.

She said she told him to run because the guy “might be a rapist.”

Trayvon said, “Quit playing with me,” which she understood to be a request to stop freaking him out. Nevertheless, he told her he was going to try to lose the guy by “running to the back,” which appears to be the grassy area between the two buildings that contain the two-story townhomes. The call terminated unexpectedly and when she reestablished contact, he told her that the connection was broken because his headset detached from his phone while he was running. He said he thought he had gotten away from the man and he was going to proceed to Brandi Green’s townhome where he was staying.

Then he said, “the niggah is following me.” She explained that people in their age group use “niggah” when refering to another person and should not be confused with the N-word.

Then she heard Trayvon say, “Why you following me for?”

She heard a loud and authoritarian male voice demand to know, “What are you doing here?”

Then she heard some sounds that she described as “grassy noises,” followed by Trayvon yelling, “Get off, get off.”

She lost the connection at that point and was unable to reconnect with Trayvon.

She admitted that she did not attend the wake or the funeral and briefly lost her composure when she explained why she did not attend and why she lied to Sybrina about her reason for not attending. She choked up as the tears began to flow. She was unable to speak for a minute or so as she dabbed at the corners of her eyes with a tissue and struggled to regain control over her emotions. Finally, she said she could not bear to look at his dead body.

Bernie de la Rionda finished his direct examination by asking her if she could identify the person who uttered the terrified death shriek.

She said, it was Trayvon.

Don West cross examined her for about two hours with a series of tedious and forgettable questions that appeared to be designed to run out the clock so that she would have to return to court tomorrow. I say that because he did not ask a single question regarding what Trayvon said to her and we already know that the defendant admitted to the police that Trayvon asked why he was following him and the defendant responded by demanding to know why Trayvon was in the neighborhood.

The cross examination took a sadistic turn when West attempted to exploit an inconsistency between her in-court identification of Trayvon as the source of the shriek and her statement during her deposition when she said she thought it was Trayvon.

After she admitted the inconsistent statement, West asked Judge Nelson to recess the trial until tomorrow morning. When she asked him why he could not conclude his cross today, he said he had at least two more hours of questions.

When the witness heard him say that, she responded in a loud do-not-mess-with-me voice, “No, that is not going to happen.”

West laughed in her face.

Without addressing either of them, Judge Nelson declared court to be in recess until tomorrow at 9 am.

Several people in the thread have asked whether her response may have damaged her credibility.

I cannot speak for the jury, but as far as I am concerned, it did not because West deliberately exploited her emotional pain to play with her mind and provoke an angry response.

I think the jurors understand, or will understand by the end of the trial, that there is no functional difference between saying, “that sounds like Trayvon,” or “I think that’s Trayvon,” or” that is Trayvon.”

We are talking about a terrified shriek uttered by someone who has just realized that they are going to be executed. It is a protestation against the injustice and inhumanity of what is about to happen.

We have no word or phrase in our language that adequately expresses the horror Trayvon felt when he uttered that sound. Indeed, his awareness in that moment was incapable of definition or by resort to language.

Yet, he uttered a haunting and unforgettable shriek that a part of me understands leaving no uncertainty in my mind that he was protesting what was about to happen.

No one teaches others how to make that sound and there is no source we can consult to instruct us what it means or how to reproduce it.

I would call the shriek inhuman, except that I know a human made the sound.

Because the sound is unique, unambiguous, and easily understood by anyone, no matter their native language, I do not believe that anyone can positively identify a person who uttered such a shriek without considering the context of the situation that produced it.

In other words, a person must believe they are about to be executed in order to produce a sound like that. Total. Panic.

That is why people are identifying Trayvon as the source using language like “I think” or “I believe” that acknowledges the uniqueness of that sound while nevertheless knowing exactly what it means.

There is only one person who knew without doubt that death was but an instant away and it is not the person who had the gun.

There is a reason why that shriek ended with the gunshot.

The reason is the gunshot silenced the scream forever.

That is what we know, whether we knew Trayvon or not, and that is why this jury should convict the defendant of second degree murder regardless if Don West wins his sadistic little game with a grieving teenager who is avoiding the limelight while suffering through a difficult time coping with the loss of a life-long friend.

  1. Thank you for the sensitive assessment, Fred. Rachel never wanted to be the public witness, never wanted all of this attention on her. People–white people– that don’t “understand” her are guilty of more than just cultural ignorance. They have wrapped themselves in a cocoon keeping out every unfamiliar sort of person that might wake them from their hibernation. I see the Rachel Phenomenon as a microcosm of our country’s racial divide; sadly, racism is still strong and blatant in these United States.

    I’ve just watched gz looking at the jurors and as far as I can see, he doesn’t like what he sees one bit. Time is now 11:02, so whatever that translates into in the subsequent videos, you can see it too.

    West is actually rehabilitating this witness without even knowing it…I am sure BLDR will get her to explain why to a 17 year-old black boy that is being watched by a creepy ass cracker is racial to her.

    It is not a good feeling to know that you are being watched by someone with no explanation and all you are doing is standing by mailboxes being black. Sounds effing racial to me!

    dare i say…she lives in Miami…what’s the educational system like in the neighborhood where she lives? Probably vastly different than the school system West’s own children would have been a part of. Lack of access=lack of education=but honest as fuck.     I don’t know why people think it was such a bombshell she said she didn’t know if it was Trayvon Martin’s voice. i don’t expect anyone to know for sure unless they saw Martin in the act of screaming or are familiar with his death shrieks.

    What is telling is that she said the he had a baby voice. The jury will replay the 911 call in the deliberation and come up with their own opinion on it. It sounded like a kid screaming not a full grown adult.

      Probably can barely read at all. I’m about sure she is a recipient of special education services. Its sensitive to some people, but its a fact that some individuals have learning differences. I have many students who get services.

      It seems like west is WORSE today than yesterday with trying to humiliate her. Bernie needs to be viligant today. The thing is that if allowed, west will NEVER stop questioning her. There has to be some kind of limitation imposed on him.

      I also think they are trying to make DD’s testimony into a big hairy media deal to draw attention away from the gym teacher’s testimony because it was FIRE. Lets face it. She was 100% credible & unimpeachable. They are like, “move along. nothing to see here.”

      Shellie is not rolling anywhere away from GZ. She is a large part (no pun intended) of the dysfunctional Zimmerman family and to some degree enjoys the fame and racist support, but especially the free money from the Zimmermann beg site that keeps her fat azz from having to work at a real job, which apparently she was not doing prior to the murder of Trayvon.

    I had a hard time sleeping last night. Every time I closed my eyes, I could see Rachel on the stand, shaking, so upset. What are the chances she has an easier time today? Not much, I suspect.

      I believe she will walk in to court today with a better handle on West and how he tried to trip her up. We all hope she slept well and is better able to deal with her emotions. I think testifying early in the day will also be better for her as opposed to the end of what had to be one of the longest days of her life.

    I feel terribly bad for Rachel. I think that West is a disgusting Human being but what is even more disgusting is what the NUT HOUSE is claiming. On their opening page for the day this is their quote….

      Again, if true, this shows the lengths the defense have gone thru to discredit this girl because her testimony alone could convict George Zimmerman. She is a near eyewitness to the fact that George Zimmerman lied when he said he had stopped following Martin and only utterered five words, ” I don’t have a problem” when in fact we know he uttered at least six aggressive words, “What are you doing around here?”

      Again I ask, have they not been following this trial? Today they are going to try to impeach her testimony from yesterday. God, the brilliance from that house of refuse is blinding.

      These people vote and carry guns? It is terrifying. Yesterday when their leader was on a manic high, posting 3+ times a day with paranoid stories that almost sounded like bomb threats (all these things that were going to “blow” this away, up, out of the water, etc.) he was feeling sorry for Rachel because she was being held hostage by the evil scheme team and he wanted to run in there and rescue her and they all went on and on about how they felt sorry for her, poor thing, they were praying, etc. Now that he’s changed his mind, they are all back to trashing her.

I feel it in my stomach. Guy was right it’s only the beginning of day four and there can be no doubt, George Zimmerman killed Trayvon Martin because he wanted to.

      Tee she wasn’t allowed to talk to any of the lawyers after she left since she is still considered to be “on the stand”, but I agree with you that she will come back with a renewed sense of strength today. She has been the star witness in this case with her raw honesty and courage under fire. There is NOTHING the defense can do, her honesty is loud and clear. If West tries to bully her again the jury will start to hate him. She is the star witness in this trial and she is doing an awesome job!

        Someone said she has her own lawyer and I believe she was permitted to speak to her attorney and should be better prepared for West today. Now she knows how he will come at her and I believe she will be even stronger on the stand today.

        I just pray that if this does not result in a Fogen conviction, she will not blame herself. Poor kid feels guilty for not being able to do anything for her friend that night and I hope someone helps her to understand that nothing was going to deter the killer.

        My heart aches for her and I don’t know how Trayvon’s parents are able to sit there showing such courage and grace. I would not be able to do so well.

          Thanks Leisa I didn’t know she had her own attorney, I’m glad about that and you are right she would be allowed to speak to her own attorney.
          I do not see how this could NOT end in a conviction unless there is a true stealth racist on the jury, which I pray there is not… but I still feel for Rachael and all of Trayvon’s family… I too would not be able to keep it as classy as they have.

    I agree 100% and appreciate your insight when describing the death shriek. I also found her description of the man who she heard confront Trayvon as being out of breath as being very impactful (word?) and credible. She also included phrases that might “look” bad (“cracker””niggah”). This fact tells me she is willing to tell the truth and puts that in front of trying to look good. I find her very credible and believable. How Zimmerman can sit in that courtroom and witness the pain by Trayvon’s family and friends is beyond me. I for one truly felt her pain and distress and it broke my heart and clearly was felt by Tracy. I see now why OM did not want the family in court.

      The jurors don’t “hear” what we “hear” because we know too much more than they do. But one thing that has become abundantly clear to them is, there is no problem distinguishing between the voices of gz and Trayvon. Trayvon sounds like a kid and gz sounds like an adult, so that’s pretty simple and I’ll bet that’s what they’ve picked up so far.

      There must be some rule whereby JN can cut off West’s attempt to drive Rachel from the court so he can have her testimony stricken.

        Don’t you think Judge Nelson is on to West? I don’t believe I have ever seen such disrespect and maybe even contempt from a judge to an attorney as Judge Nelson showed to West yesterday and I hope the jurors took note of what she thought of West and his tactics.

          West is keeping DD on the stand waaaay too long. If he gets anything on account of a witness misstatement, he’ll have nothing at all. Since the longer you keep nagging and nagging and nagging a witness about minutia the more opportunities there are to obtain conflicts.

          Where we are now my guess is the jurors expect her to start making slips and mistakes if only from irritation. She’s still grieving for her close friend of many years, West is being obnoxious, unfeeling and calloused towards her.

          DD is becoming combative, good, go girl!!! Should West keep her on the stand for another hour or so the defense can just forget about this case, gz will be done! Small prize, since his goose has been in the over for days.

          I’m watching day 8 with the dna guy. West is going on about dna degrading rapidly when wet. So the mildew smell of Trayvon’s hoodie is his focus. He doesn’t remember reading in the evidence that when Tracey let him pick those clothing in the garage, they smelled of mildew and probably mothballs as well.

          All that screaming and kicking about discovery and then they don’t even read or look over what they get! SMH

    I loved when she said that Trayvon had a soft baby voice, it was the first time it had been mentioned. HLN, posted it soon after, I would hope that the prosecutor expound upon that fact because West sure was pushing that lie yesterday that Trayvon had a deep voice.

    1. Trayvon said “oh shit” as he tried to get away again as Zimmerman came upon him for the second time. So he was the one surprised and ambushed by Zimmerman.

      Because the defense has nothing, he’s trying to impeach every witness on minor discrepancies.

      I noticed a twinkle in his eye a few times when he felt he manipulated the witness. Especially, when he claimed there’s at least 2 more hours of cross-examination for Rachel. He’s so full of crap!

      It was almost funny how Rachel suddenly switched from sweet, to annoyed. West must have worked her last nerve,and then some, at her deposition. I could tell immediately that she didn’t like him at all.

      Can you blame her? All this BS on trivial, non-important things. He knows fogen is guilty, which is why he’s not really focusing on the real issues.

      They have nothing!!! Nothing at all!!! But at least we know they don’t have a paycheck, either. 🙂

That’s what t’s about… Not Crump or what she said to crump. my god they threw her in a freaking closet, she may be homeless, because her mom is in Haiti. They believe they have the right to control people’s lives. this sequestration Jury with West going on and on and on. It could take 2 full months, If you go broke they could not care less.

    Don West’s goal was/is single and simple: Impeach Dee Dee.

    West, an attorney with dozens of year of legal experience tried – for over 2hrs – to achieve this one, simple goal. His opponent is a 19 year old daughter of migrants of South American origin. Her name is Dee Dee. Dee Dee’s first language is NOT English.

    Dee Dee demonstrated to West that she is smart; that she is confident; that she remembers events well and can relay them coherently; that she is a “straight talker” and says it as it is, and is neither pretentious nor presumptuous; that she is not- and cannot be intimidated by him (West) or any other person. Dee Dee started with “good afternoon, Don”. West was taken aback. And the fight started.

    For over 2hrs West was all over the mag with Dee Dee. And for over 2hrs this 19year old owned West. West got nowhere with Dee Dee. All West wanted an “impeachment”. But Dee Dee won’t give it to him. As the drama unfolded, it seemed that the veteran attorney West does not even understand what “impeachment” means and how to impeach, for, to get an impeachment, West needed two material statements that are OPPOSITES of each other and made under oath. Statements that are NOT mutually exclusive cannot lead to impeachment. No such statements exists in Dee Dee’s testimony. West tried other tactics in an effort to get Dee Dee confused, confuse the subject matters and make damaging statements, but he ultimately failed. Dee Dee owned West.

    So, here we are now: West won’t admit that he has been beaten by a 19 year old girl. West can’t believe what happened and wants another round of fight. He requested one and got it. I saw the big relief on West and O’Mara’s faces after Judge Nelson determined that the testimony would continue the following day. Dee Dee has been portrayed as a dunce by Jeralyn Merritt and jackals at the CTH. They claimed that Dee Dee is damaging to the State and will not dare show up. O’Mara and West has promised to deliver Dee Dee’s head on a silver platter if she dares take the stand. But behold, show up she did. And she turned the tables on them.

    Today, Dee Dee will finish her testimony. I do not worry about her abilities. I admit that she out performed my ill-informed expectations of her yesterday, (sometimes Dee Dee even took over from West reminding him that he got the dates wrong, etc). I am very happy with the news from Whonoze that Dee Dee has legal representation. All Dee Dee needs now is to just remain calm, answer questions and not let West get her angry – until she leaves the Court house. Her attorney, I am sure, will see to that.

    There is nothing to impeach and West won’t get his impeachment. West got beaten yesterday. West will be beaten again today – By A Girl.

        The asian lady, no matter what Omara says, knows what Fogen looks like, therefore, she can say for sure, it is Fogen

        Omara simply made the jury even more sympathetic because they now realize, Trayvon, really was just a kid

        West did not shake up w18 and she stood firm to her oath as to what she saw, and her testimony matches the Azn lady and the forensic evidence which will be introduced

        3) Forensic Evidence collected by CSI tech Diana Smith

        4) the preceding 911 and NEN phone calls of Fogen

        5) HOA president says his presence was not necessary or wanted

        6) It’s fact he killed Trayvon

        7) The 911 scream recording

        One supports the other, it’s like a checkmate in chess

        IMO, the most damning is w18 and the forensics, Fogen’s own NEN phone call… she is one of the keys that holds the whole thing together

        Sit and think about it, because this is not a one piece evidence case, it’s bits and pieces put together for the checkmate

And certainly it could have been someone else because Rachel assumed there was a fight because common sense says if she didn’t hear the gun shot on the phone then Martin was not shot immediately and likely fought for his life. However, no neighbors saw a fight but rather a brief struggle.

    What are the chances that Zimmerman, who was close enough to see the button on.Martins shirt, and Martin, who was close enough to Fogens truck to notice he was not black, actually heard Trayvon call him a “cracka?” I noticed the defense and Fogen turned pale white when Rachel said this and it’s remarkable that up until this point West has not brought it up. What if there is a text from Fogdn using the words “creepy cracka.” It just struck me that they were so taken aback by it. I really think BDLR should have asked her where she thought Martin was in relationship to Fogen when he said that. He should have asked did he say that near the beginning, middle or end of the call. I submit to you right now that Zimmerman watched Martin for some time before even calling police and this comment from Tray may have helped trigger him to call the NEN and purposely mislead them with the wrong clubhouse address, add false details to the call and force Martin into a confrontation.

Sensing Martin’s outward. frustration of being followed made Zimmerman become even more aggressive and he made sure Martin knew he was being followed. He fully expected Martin to approach his car so he could shoot him dead there but Martin ran and he was pissed at Martin / and could have been well aware of the fact that Martin could have called in and reported a strange man following him in his car. My point is that the malice and evil intent dripped from Zimmerman’s phone call and it is certainly possible that hearing what Martin said sent him into a murderous rage because he definitely killed that young boy as he screamed.

He could have flipped him the bird or anything but I believe that in addition to his frustration with burglars Tray did something BEFORE he was confronted by Zimmerman to further enrage Zimmerman towards him. Trayvon certainly didn’t attempt to kill Zimmerman because DNA doesn’t lie but there is clear malice toward Martin even today and it could be because of some words or gesture Martin made while Zimmerman was in his truck.

The truth in this kind of situation is always raw (and heart wrenching). Dee Dee talked ‘raw’. She gave it to them as it happened. And average individuals would have reacted as Trayvon did in Dee Dee’s words. That’s a big plus to Dee Dee’s credibility. Frankly, if I were Trayvon, I would have aimed my firearm at GZ, order him to walk away or I shoot. Unlike me, Trayvon wasn’t even allowed to bear arms – being a minor.

    Just because Trayvon was shot in the chest, it certainly can be a possibility that Fogen was on top of Trayvon, when he shot him… Fogen could have easily been on top, did the murder, and then rolled the body over

    Instead West tries to proclaim some acrobatic Jackie Chan move on the ground that makes no physically sense in terms of physics, biology, and science which is just as bad as his knock knock joke

    Hypothetically speaking, if I was one of the female jurors, I would be insulted by West trying to treat me and the other females on the jury, and the witness, as if they were stupid

    It’s already bad enough that West, once the crime scene tech came in, and the photos, West already looked like a big fat liar

    I also feel that her and Manolo were believable, and the jury already heard the 911 scream tape, and the witness saying “it sounded like a boy” will linger in jurors minds… the jury also already heard Fogen’s voice on the numerous phone calls he made, and I believe it makes w18 more credible because it does indeed sound “like a boy”

        To insinuate to the jury that Trayvon moved slowly, maybe even stopped? How could she really know where exactly he stopped, she had no visual clues to connect his words with images. That she told him,, I have never been there.

        Our impressions are not important these ladies may not like him, but he may well get some insinuations into their heads.

        I have not really calmed down. They need and want to take her down. Does anyone doubt that?

          Hesitatingly she finally answers, the gesture with her hand, almost not perceptible signal resignation to me. She does not quite understand what it is happening, she probably did not quite understand then.

          DD: It might have been, cause we had the same issue, my voice so.(here the clerk does not understand, probably no one else did get that, she does not repeat it for her, so it won’t be in the transcript) Might have been. Might have been, yes.

          Nelson?: Speak in the microphone please.

          West: So is that your answer or not.

          DD: (hesitation) Yes.

          West: So what you are saying is, indeed what you told Mr. Crump in this recorded interview that what George Zimmerman said in response to him saying: What are you following me for? Why are you following me? George Zimmerman said: What are you talking about.

        I suspect the “what are you talking about” may have been HER asking HIM what he was on about, not her saying that’s what she heard GZ saying. His questions are so convoluted, you have to parse them and pull them apart three times to understand what he’s trying to ask.

        He really IS the secret weapon. First he confuses the witness. So they answer wrong. Then he’ll claim in summing up that the witness said XYZ, and the jury will be so confused they’ll recall the witness having said that, but not recall what question it was the answer to.

        Hopefully, Bernie will redirect her to clear up these points.

It’s too bad Crump didn’t have a closet to enter as well, as he might have gotten a better recording that way.         Did I get something wrong. I still hope we get a little bit of cell phone tower location data that does not fit into Fogen’s narrative. But if that was the case, would we see these desperate attempts to impeach DD? Or is prosecution saving some tidbits for later? And defense spent much too much time chasing after media misinformation that caused Fogen’s arrest? Trusting Fogen that everything he tells is true.

    I think she is actually a sympathetic figure. Raw, candid, extremely blunt, unfiltered, ingenuous. She has nothing to lose, and no reason to lie or put on a front. She has clearly been traumatized and this entire process has likely been nothing short of a perpetual nightmare for her. All the defense can do is try to confuse and annoy her (as well as the jury) with minute details in hopes of tripping her up in a lie. Attacks on her character are a dime a dozen on social media and should be ignored.

      I agree, but I am a bit disappointed in how they used the audio without actually asking her. The whole scenario is going to make a lot minds fly.

      Now it almost looks as if, maybe, just maybe Serino could have a done a much better job had they given him access to the phone records, which it seems they did not give him, since they did not trust SPD.

      I agree totally with you. I also believe that this young lady life is forever altered. Did anyone think for one minute that she lied about her age because she didn’t want her friends to know that she was much older than them. Do anyone remember how terrible kids are to each other so now this girl may not even go back to school because everybody knows now that she’s going to be the oldest person in her grade. That’s why this girl didn’t want to come forward. do they know what mean ass people are calling her, Fat, black, dumb, & moron to name a few. We know that these are grown people on the Internet doing this imagine what kids will add once they find out her real age. This is why people keep their mouth shut and don’t say anything to the police or anyone else’s about witnessing a crime. I hurt for her!

        Although is it possible people don’t know your age in school? I admittedly wondered about her thyroid functions, I may be wrong though. And I do not have the slightest idea of the larger field. I had a female classmate for a year or so, I loved the girl, who was almost two years older than us, since she had polio and couldn’t go to school for almost two years. It was really hard in her case. She was one of the brightest girls I have ever met in my schooldays. After a year she was gone again. But she is the one that comes to mind always when I think about the girls in high school. I still remember the things she told me about. The best conversations I ever had at that time.

    I pass out when I am confronted with an extreme amount of stress like being at a love one wakes and funerals I try to avoid them at all cost. My best friend of 20 is still mad at me because I didn’t go to her cousin funereal, I went to her uncles but I just couldn’t bring myself to go to the cousins’, didn’t want to experience that feeling so I lied to her. I later apologized but I still lied and I’m a grown woman.

        She heard the ABC interview, I guess that is what they played for her, the fist time. She had needed to sit there all morning long getting more and more nervous till it finally started at 2 p.m. Then she was confronted with the video camera that BDLR couldn’t prevent and I think she got into a trap and confirmed the expertise of Jeralyn Merritt and Diwataman with their respective Sony Sound Forge “cleaned copies”.

        And I think she was lured into a trap and simply confirmed what they wanted to hear, that is that Fogen responded exactly as he claimed he did. Which would make her later statements in this context a lie.

        Fogen claimed he said: “What are you talking about”

        Exactly what Jeralyn and Diwataman want me to hear for quite some time now. But I don’t think this actually what she said.

        If you think this is nothing, that is at the core of her statement about the encounter, than think again. They lined up two lies already and now they want to expand that into her statements about the encounter. Look all the time she said this, and here she said this.

        But I noticed that BDLR paid attention and that she did not really confirm what West wanted. In any case I don’t hear it, but I may simply feel over protective towards her. I think she will be OK. But she has to be careful not to show her anger, she cannot control how the jury interprets that in the larger context of other lies. That is exactly, why he wants to lure her into outburst or anger. Good that she can calm down and, I hope someone tells her, that should not happen again. She can express her emotions politely tell him that she feels uncomfortable by his interpretations, since he does not get it right. That the jury will understand far better than angry outbursts. That’s why West is trying to lure her there.

        I still think, she did not completely understand what happened or if she does, she is not able to express herself well enough. She makes this too much an intimate exchange with West, he is playing to the audience, for effect.

        With rush, she means she talked to fast. Crump: talk SLOWLY. If you talk too fast you don’t pronouce all the syllables your slur.

        Tell me, why I do not hear: “What are you talking about?” Tell me where the exact confirmation bias lies. Is it possible West can suggest to her what she supposedly said, and she does not challenge him? Is it possible that after all these years my ears are obstructed by my mind. Is it possible she is so suggestive that she accepts his ears. Remember he always claimed he could not understand her. Is it possible just like a bad handwriting you are not able to understand anymore what you said, they way you cannot read a highspeed notes? Your own handwriting?

        Tell me what you hear. They gamble with the fact that she is not easy to understand, at least if you do not get slightly used to the way she talks. Tell me to what extend they want and will be able to exploit it?

        What troubled me was that Bill Shaeffer who completely was on her side, found her convincing, spoke of a partial meltdown after this passage.

        I could go on and on. 1 hour 30 minutes still.

        Seems Fogen is praying, I know the Catholic disguise of folded hands. Watch him. It may well be a stage show for the camera. But I wouldn’t completely rule it out either that he never awoke from his paranoid dreams.

If I were the DA I would start asking to look at whatever the defense wants someone to read from and make sure it’s the same thing. Think about it, they’ve even slipped in a few lies here and there.     During jury selection, we kept hearing people say they didn’t know why this particular case should get so much attention, and variations on that theme. We have read bigots over at the Outhouse and even some third-rate radio announcer opine from their lofty “more equal than other pigs” pedestals that in one way or another, for one reason or another, Trayvon Martin either deserved to die or brought about his own death so it doesn’t matter. We saw people fish up crimes committed by some totally unrelated African American against other totally unrelated white victims, purporting to show some false equivalency which they indignantly broadcast as a delegitimization of the right and responsibility of the State of Florida to prosecute Fogen for murder.

    What does all this say?

    It says that the “whole world” represented by Trayvon Martin is not a valuable “whole world” so destroying it is not a big deal.

    But let’s see who got caught in the net of that “whole world”:

    Chief Billy Lee lost his job;

    Wolfinger lost his career and his prestige (what remained of it);

    Patty Mahaney lost power in the community;

    The HOA lost over a million dollars;

    Many of the RTL residents lost their homes;

    Other RTL residents lost equity in their homes;

    Fogen will probably lose his freedom;

    Shellie may lose her freedom and will almost certainly lose her husband;

    Joe Oliver claims to have lost (given up) HIS job;

    Osterman lost his anonymity which can have a negative effect on HIS job;

    Taaffe lost a lot when both his son and daughter went public with their scorn and anger at their father for his abuse of them;

    Serino may have lost status within the police force;

    And the murder of Trayvon Martin is the UNGIFT that keeps on taking.

    There is good sense in what the Talmud says.

    Whether people value the life of another or devalue it, society has a lot at risk if this murder goes unpunished. Of course, I do not think it will.

    Thanks to Ms. Fulton, Mr. Martin, Mr. Crump, Ms. Jackson, Rev. Sharpton, Jesse Jackson, and the millions. It is a tiring and tough trial but it is as necessary as the U.S. budget.

    One eyewitness admitted her basis for saying who was on who was due to photos of Trayvon as a youngster. Another heard three shots and one must have gone through the back the way she describes things.

    Dee Dee was not only impeached but gave testimony beneficial to the defense. On direct she said that Trayvon asked the defendant “why you following me” and he responded “what are you doing around here.” But West provided the deposition where she said he responded “What are you talking about.” This not only shows that she’s since tailored her testimony but that the defendant was the confronted and was perplexed by the accusation of following.

    Its also no small matter that on direct she stated it was Trayvon screaming but had previously stated she didn’t know. As far as the “get off” if you listen to her deposition it’s clear that she’s adding that “kinda like get off, you know a small get off” because the state wants more. West will get to that I’m sure but if the state cannot really rehabilitate her, her credibility is gone.

    I think West could’ve handled Dee Dee in a better way and the lie about the funeral was valueless. The lie about her age was important however because it showed she could be crafty. After West impeached her with her previous deposition I think his manner no longer mattered.

    I must be incredibly biased because it really seems to me that with the exception of some law enforcement witnesses the state has been presenting a defense case these last few days.

      Everyone meet Dennis P from Facebook, a Fogen Supporter, one of the TM supporter bullies from the diseased page and HLN’s Event’s page.

      The Asian lady – her testimony is she knows what Fogen looks like, hence, she knows she saw Fogen on top, and he shot the boy, and simply got up and walked away. West tried to confuse the issue and the lady still stands firm that Fogen was on top of Trayvon, shot the boy, then simply stood up to his feet.

      The Empathetic Teacher – her testimony remains exactly the same. She heard an aggressive confrontational voice whom she attributes to Fogen. She heard what she would describe as a young boy screaming. She saw Fogen on top of Trayvon. She saw Fogen shoot Trayvon and simply rise to his feet and move around. West tried to bully her into changing her statement with nonsensical BS, as if the fact Trayvon was shot in the chest makes it impossible for Fogen to be on top. She stood firm and stated that “she can only testify as to what she saw and heard”.

      Rachel – Rachel’s testimony, is supported by Selene, the asian lady, and the Empathetic Teacher. Rachel’s testimony connects all their testimonies together. I agree that she is rough around the edges but I believe that’s what makes her credible and real.

      Lastly, anything a lawyer says is not evidence. What the witnesses testify is evidence. Fogen has not testified, therefore, his testimony is not weighed yet.

      We can only speculate as to what the jury thinks, but, IMO, the defense was really rude to the ladies testifying, as well as, they were confusing to understand to the jury. The defense from yesterday were shown to be liars, when the jury saw Fogen’s face, and it buries West’s beating claims quite a lot. The jury also saw Trayvon’s hands up close, and now, Guy looks credible. I also feel the state comes across more sincere. West comes across as very phony.

      Even though West tries to confuse the jury, the judge will explain in the end, that for an affirmative defense, the defense must present evidence to support their theory, otherwise they do not get a jury instruction, and it’s pretty much fact Fogen killed Trayvon. It is only when West appropriately raises self defense, does the state have to disprove that. So far, all that has been shown is Fogen is a liar and a creepy stalker.

      I am only human, so I can be wrong as anyone else, but I personally felt it went well today. Rachel was a little rough around the edges, but Bernie can honestly show in redirect how her testimony is supported by the other witnesses.

        In redirect he doesn’t even need to show that other testimony supports Rachel’s — all he needs to do is help Rachel redefine the important points, re-emphasize the actual earwitness stuff, and then let this young “salt of the earth” woman with the beautiful hair and nails return to her world, richer for her having climbed the mountain and fought the dragon, poorer for the absence of Trayvon Martin.

      I made on Whonoze blog, a point-by-point check of Rachel’s account to BDLR. She has a very stable story. Much more stable than GZ’s.

      The fight about GZ’s answer to TM’s “why are you following me for” is smoke and mirror at this point. This is defense strategy to spend a lot of time on a minor issue t make it look major. But over all, it looks to me that she stood her ground quite well.

      What I got from RJ’s (DeeDee’s) narrative on day 3 with BDLR is the following:
      1) TM, coming from the store, used a short cut to get to the mailbox area.
      2) While at the mailbox area, he noticed GZ watching him (That means TM was at RATL’s mailbox),
      3) He decided to resume walking home,
      4) GZ followed him (I could not tell if it was physically or by sight),
      5) TM decides to run from the back (the meaning of “from the back” is still a mystery)
      6) The phone connection is lost, she calls back (in line with evidences)
      7) TM told Rachel he lost GZ and that he was by his dad’s fiance’s house (By the house came earlier so the meaning is not clear)
      8) He decides to walk
      9) He notices, a couple seconds later, that GZ is still following (this is a change in time scale as in previous accounts she stated a couple of minutes later)
      10) She stated that she stopped talking with TM for some time as she was fixing her hair
      11) She heard TM say “What are you following me for?” (no change there)
      12) She heard another voice saying “What are you doing around here?”
      13) She heard a bump and the headset falling on the grass
      14) last she heard was TM’s voice saying “get off” 2x
      To my senses, the core of her account has not changed a iota.

      Dennis, anyone who is as “critical” as you (IMO) pretend to be MUST FIRST read the whole deposition transcript in order to put- and interpret whatever Dee Dee said in context. Right now, you don’t know exactly what Dee Dee said. Heck, you have not even seen the deposition transcripts and you are already making sweeping conclusions that are on the face of it ill-founded.

      I’m sorry but your friend Zimmerman got those boo boos all by himself because there is not a trace of forensic evidence that says Trayvon touched Zimmerman’s head or face.

      The blonde woman testified that the scream was a boy and that Zimmerman was on top.

      Neither woman said Zimmerman was getting an MMA beating, so that blows that part of his story out of the water.

          I’ve considered writing on this, applying the conceptual model I created for a critical analysis of the Tea Party and the new Right to the Zidiots. After spending four years wading through Tea Party & general right-wing crap, I don’t know if I’m up to the task of slogging through a year plus of CTH posts.

          I could ditch the theoretical analysis and simply write on this case in a larger context, using the CTH throughout to demonstrate what seems to me to be an underlying hysteria nearly identical to the one I argued drives the TP and the Obama-era right wing.

          By the way, it was your timeline videos that really quashed any doubt I had about this case early last summer. I can’t wait until the jury sees it, after all that they have and will hear pre-dismantling GZ’s various accounts of the story.

    • Actually I found BDLR brilliant on that one.

      Defense is pushing hard on every little inconsistencies from witnesses. If there is one inconsistency, they can spend 45 minutes on it giving the false impression that it is major.
      In the case of Jeannie Manalo, defense spent a lot of time trying to refute the ‘bigness’ comparison she made.

      I was wondering when will BDLR close that issue by reminding everyone that Jeannie referred to the weight rather than the height of the two protagonists. Old or not, TM’s pictures show him skinnier than GZ.

      But BDLR had a better idea. He closed this issue wonderfully by reminding everybody what she really said: “the guy who who was on top was the guy who got up.”

  69. i THINK Rachael did ok, not great. She was never the State key witness, IMO. Her lies are understandable, by her testimony she thought Z was already in jail. She told West four times she doesn’t watch the news, so why keep asking? Personally, I think the older lady has been the best witness. Rachael is only an ear witness, despite the darkness, the older lady is the better witness, she saw some of incident, not all.

I talked to 3 people today who confirmed that Sybrina pressured the entire family of W8, and used the leverage from her coms with Miami-Dade BGI insiders, naacp etc, to put pressure on W8 and her family. W8 wanted NOTHING to do with the scheme. AND THIS IS A SCHEME.

    Witness 8IMHO W8 needs a witness protection program. If I could afford it, I would pay for it myself. If she tells the truth of all things she will be in danger. REAL danger. She’s welcome to hideout here if needed.

    IMHO,… and no,… I’m not trying to tell the defense what to do, or influence them in any way… I’m not important, I’m not self-indulgent, and I’m damn sure not arrogant enough to do that….. I am a person of no particular consequence and this is just my opinion: Don West needs to revisit the framing of the Probable Cause affidavit with W8 on the stand. There is a way he can bring this in. It relates to the probable cause affidavit and the Florida Attorney General Pam Bondi (highest elected judicial position in the state) speaking about the case.

    Did W8 *refuse* to talk to authorities [think Crump letter to Tom Perez]? Answer NO. (so get this out in court)

    Did W8 want anything to do with this? Answer NO. (so get this out in court)

    Did W8 know Crump was going to use her to manufacture media evidence? Answer NO. (so get this out in court)

    W8 was pressured from the outset to tell a very specific tale. She was painted into corners with no escape by horrible people with horrible agenda’s. She is now under threat from them. Which should be another line of questioning while she is on the stand – all of which is possible questioning if WEST thinks SMART and uses the PCA to frame his question(s).

    I’m sorry, really sorry, but I am burning the candle at rapid rates on both ends. My nerves are frayed…. But damn it what these folks have done is wrong on so many levels it just staggers the imagination. Matt Gutman is an asshole. What a jerk to go along as a willing accomplice…. for what — Ratings? Exclusives? There is a place in hell for what these folks have done to George Zimmerman and to Witness 8.

    How to get them all *outed* is dependent on two things.

    #1.) West/O’Mara’s keen intellect and capacity to use the PCA framework to ask W8 on the stand how this all was put together. It will be objected to and they need to have pre-scripted responses to the objections. (Of course this assumes MOM and West want to do this for George)

    #2.) The truth from inside the M-DSPD reaching sunlight. {I’ve got that aspect. I pray}

    If both of these can be accomplished the case will be dismissed – it will have to be.

    But the viewing audience does not know the construct of the scheme like we do or like West/O’Mara does. That’s why the questioning on the stand becomes so darned important.

    Immediately following the finished testimony of Witness #8, ask for a recess and DEPOSE CRUMP !

    I will write more soon after I listen to the testimony again while showering and fixing a sandwich. However, revisit the post(s) that will fall below this one. They are old but of much significance.

      Dee Dee is there to do one thing fill in part of the blank in the states narrative of that night’s events and the linear aspects of their theory of the crime, she is a small part; If they stopped with her they could not convict.     I am really getting tired of the childish play on FB using Rachel’s likeness along with ridiculing captions. I got into a heated posting war with a friend of mine who forwarded one such post. I am usually quite dignified in my way, even on social media. Today, I wasn’t so nice.

    I will not post what he wrote, but below are my three responses to his childishness. I think I will stay off FB for a while.

    1. This young lady is having to endure some sleezy crap from the defense. She is holding her own and being truthful. Leave her the eff alone! Please.

    2. She may not have counsel. She has probably never been in a courtroom. She is afraid and out of her element. The prosecution can not re raise her. They cannot put words in her mouth, and she does not have he means to travel to Sanford at will to be “coached” by the prosecution. All she did was tell the truth, and West tried to beat her down. You are welcome to disagree, of course, but I applaud her for holding her own for the most part against that bully West. Her life will be impacted forever because of this. Something she did not ask for. We as adults do not need to feed the racists who have been doxing and bullying her for over a year. Justice for Trayvon!

    3. To think she should have done better is one thing… to perpetuate the bullying is another. We are better than that.

    Among Rachael’s testimony of what Trayvon told her and what she heard, I also heard her communicate something to the judge and jury; i.e., West deliberately frustrated her when scheduling the continuation of her deposition.

    Here is a 19 yr old high school junior. She has school, homework, a social life. Regardless of her age, she is still a high school student who West required to arrange a schedule as if she is an independent adult.

    West.made.things.personal. and tomorrow, Rachael might just turn into Madea on West’s ass.

    Professor, I have to say that I am so glad that you could see into her soul, even though her court Etiquette. Because blacks have been conditioned to stay away from trouble that would end them up in court well at least the majority, there is to many blacks in jail for things
    they haven’t down. So to put a 19-year-old into a situation that she is not or did not want to be in was very difficult. That is why she said ”you don’t know” you just don’t know. How she is feeling to know she was the last person to talk to Trayvon when he couldn’t even say good-bye to his own mother and father. That is a lot for a kid to have to bear. However, I think that Trayvon helped her get the most important part out concerning him, and the rest she got lost because she was having a hard time comprehending what West was asking her. Nevertheless, I think through it all she said what everyone else was saying Zimmerman hunted Trayvon down and had Trayvon to have to continue to move to stay away from Zimmerman. I think that the Judge understood it was a lot of pressure on her. This is why she didn’t say anything. And when have you ever heard a Judge allow all of what she had done in court, without telling her something or even putting her out of the court. So I think they got her and got what they need to hear from her, and that was someone who was Zimmerman was following Trayvon and he asked Zimmerman what you want, why are your following me. That is all we needed to know because Zimmerman said Trayvon came up on him.

      I’m not sure what you’re referring to when you speak of her court etiquette. She answered questions. She got a bit feisty at times but that’s ok. I don’t recall her being disrespectful of the judge and as for spanking West, as long as no one objects, there is nothing for the judge to say. I suspect the judge even had a smile hidden somewhere in her robes.

      West objected to his own question but I’m not sure what that was about. “You can’t do that” said the judge. Sidebar.

    I think it’s also significant that Rachel said something along the lines of “heavy breathing”. I don’t remember the exact words but they suggest that fogen had been running.

    Rachel did very well today. While it was hard to hear and understand her at the beginning of her testimony, it became much easier to understand her later on. One thing that West help establish, Rachel has a good memory. She also doesn’t like being jerked around because of someone else’s scheduling problems. Loved that call out.

      Yes, she called him out many times! She made me laugh, cry and give her high fives during her testimony. She was so believable with her teenaged attitude that we are all familiar with. For those mommies on the jury, they will recognize that for what it is and maybe even imagine their children in Rachel’s shoes while being badgered by West.

      Why the hell does he need to question a witness for 4 to 5 hours? He repeats himself relentlessly that it sickens me. The questioning rarely leads into another question.

      West has no control over this witness as she will not only answer the question that he wants answered, but she also goes into details. Her ability to remember dates and times is remarkable!

    Very powerful post Professor. I’m sure the common sense factor is at work with the jury. The more obnoxious and condescending West is, the more the jury is likely to think he’s an obnoxious, condescending shit.

    His inability to even acknowledge her loss will alienate the jury of that I have no doubt. His focusing on her missing the wake makes him look like a sadist. I have an ex-sister in law who simply cannot attend funerals, so I can see her point.

      I can understand your ex-sis in law’s and Rachel’s feelings. My mom died when I was 19, and after the funeral, when it was time to take her to the cemetery, I could NOT go because I couldn’t bear to see that final thing. My kind, loving, understanding brother and aunt took me home and stayed with me. I was unable to even go to the cemetery for a long, long time. 19 is so young and when you lose someone you truly care about, you just don’t what to do with those overwhelming, profound feelings of loss, so, some just tuck it away deep inside until it’s “safe” to confront it. Someday, Rachel will remember the good times with Trayvon, smile and be glad she knew him. And, West is an a**hole and has not an ounce of decency in him.

    While focus centered on Dee-Dee today (and no doubt tomorrow), I’m of the belief jurors went to hotel rooms tonight thinking more of Jane (Witness 18) — extraordinarily poised and precise on the stand, while coming unhinged with emotion during her extended 911 call. Her curiosity at aggressive shouting turned to horror as she saw “the boy” left for dead on the grass,

    Here was the first witness to Trayvon’s murder heard from at trial, and she (along with Leo) brought it home. We could almost hear him meow his support for how it was. We should not underestimate her impact on jurors.

    As I side note, I can’t help but think BDLR is conducting a little value-added seminar for jurors on leading questions. On occasion, he’s asked them, immediately correcting himself before the Defense Dufuses have moved to object. He apologizes, identifying what he’s just done as what it was — leading question.

    Before long, jurors will know them when they hear them (if not already), and that won’t bode well for the Defense when it attempts to present its side in a coherent manner. .

    I almost never watch cable news but it was on at the gym and CNN was on. Everyone on the panel said that she was odd, irritable, annoyed, and a little immature, but they all found her sincere. Even the woman on there as the “defense” side of the usual cable garbage accepted her version of events but said it didn’t matter because self-defense, fear of bodily harm, blah, blah, blah. The point is that she came across as sincere because she obviously was. The idea that she was coached is ludicrous. Can you imagine trying to teach that poor girl a script to recite on command?

    I’ve often heard that Zimmerman could not be lying because he’s not smart enough to concoct a coherent lie. But this young lady somehow told a story that tracks perfectly with both Zimmerman and the physical evidence. She’s telling the truth.

The others have been more composed and less vocal about it, but I do not remember any of them not becoming annoyed with the defense. All of the witnesses from yesterday were annoyed at some point. The teacher was highly annoyed but very professional about her annoyance.

        So while Rachel is not as composed, she is fitting in with the rest of the witnesses on testimony and annoyance!

    It smacks you right up side the head as to the reality of the terror Trayvon experienced in his final seconds of earthly life.

    It also reveals the reality of what a lowlife, piece-of-shit, sociopathic coward that George Zimmerman is.

    We also have a pathetic portion of our population that has bought into GZ as a hero or some type of beacon for their cause… whether that be gun rights, race hate, or both. It’s sad.       At some point, each juror will reach that conclusion and some of them may have reached it today.

      Unfortunately, we only get occasional opportunities to observe the defendant’s reaction to harmful testimony.

      This guy had a remarkable absence of response to emotional testimony.

      During the 30 years that I tried cases, I noticed that jurors were independently monitoring my client’s reaction, or lack of reaction to emotional testimony. The point is that there is a lot more going on in the courtroom at any given time than just a witness testifying.

      Whether the defendant decides to testify or remain silent, his nonverbal reactions are being monitored more or less constantly by jurors and the same applies to his lawyers and their interaction with him.

      Some defense lawyers have little or no interest in their client as a human being. To them the client is little more than a chess piece in a sophisticated game of three dimensional Gotcha! that they play for their greater glory. They need to learn that the jury is more interested in the client than the lawyer.

      At the opposite extreme, some have too much compassion that occasionally compromises their objectivity resulting in unwise tactical decisions.

      Finding the perfect balance between those two extremes and maintaining it over the long term is difficult.

      With Mark O’Mara and Don West we are seeing two lawyers who exhibit a shoot-it-if-it-moves approach to cross examination. Strategic thinking, empathy and concern about juror opinions regarding them and what they are doing are not apparent.

      Mark O’Mara’s defining characteristics appear to be using lies to manipulate and intimidate others into giving him what he wants.

      West’s defining characteristics appear to be arrogance, a bad temper, and an abiding love for hearing himself talk.

      Both have also demonstrated substantial prejudice against and lack of respect for blacks and women.

      Behold: Karma has a sense of humor (female judge, all female jury, and many critical witnesses who are women.

      The gods are laughing at them.

        I was confused when West gave Rachel the call log with the 6 or 7 calls stamped with times and then began to question her about a time that was not stamped on the visual aid that he’d given her. She’s no dummy. Before he even started with a time not listed, she told the court that the record was not complete. I kept thinking, why give her a visual aid, read them aloud and then ask about something not listed? It did not make sense to me and I am sure the jury felt likewise.

        He appeared to be and idiot to me. He is far from impressive and the jury is watching.

      What I observed from the media regarding support of DD is that, again, people were really divided along race/class, liberal/conservative lines. I didn’t see or seek out any media that was going to blatantly disrespect her, but some people made references to it being done. I can only imagine. I read a tweet saying she has been the subject of doxing, which involves computer savy individuals doing exhaustive computer searches on you until they find you, then they publish your personal information. I had never heard of it before. She has many supporters. Many feel sorry for her. Some AA’s are embarassed by her. I will be sending her my strongest prayers and best vibes today.       DOMA, throwing out the Prop 8 issue.
      And, the prosecution made many points today. And, the witnesses did not let West mess with them.
      Humans are what they are, but today was a Good Day.

        Deborah I am good. No tea needed. I have just spent the last couple of hours listening to my husbands associates talk about this girl and Trayvon. They are the Republicans I speak of us. I hope not to offend any here. I vote all over the place, so no stones being thrown.

      @disappointed, You took the words as well as the very same thought out of my mind/mouth. some people in this country and, we all know who they are, make no damn bones about how they feel about a people who NEVER ASKED TO COME HERE, to the precious country that their ancestors stole from the very first people to settle here.

      I wish so much that I could leave this country and, never come back. these people think that just because they have taken from some and, used others, that GOD made them boss over all. not true, not true. and, oh how soon we forget 9/11. the country didn’t unite as one then and, it NEVER will. not as long as we have people who can feel nothing but hatred for an innocent 17 year old AA child.

      Other countries are watching this case and, they see the racist hatred in this country and, we better believe they are talking and, it’s not good either.

        Ladystclaire, I also want to emmigrate even knowing that racism & imperialism are pretty much everywhere. There are places where the racism isn’t as pervasive. My sister is in Australia right now & she likes it, but they aren’t without racial issues. From my experience, with certain exceptions, the racism may be institutionalized but the people aren’t as angry & hate-filled. I was really scared in Germany because when I was there, some nazi’s thru an African man off of the Ubahn & killed him. I was scared some nazis were going to run up on me and I wouldn’t know what they were talking about. There are also a lot of swatstikas in Spain for some reason. The men are very sexist there. I’ve never been to Japan, but they have a lot of Sambo references. The leaders of Japan & China believe that AA’s are a drain on the USA. I might not mind Canada, but after 20 yrs in Houston, I don’t really want to live in the cold. The super cold is out. My mom & sister really like Figi if you would be able to live a very, very slow, somewhat off the grid existance. It really all comes down to your financial resources as well. Money talks everywhere.

      • My people came here when the people who stole their land saw a massive famine as a way of clearing that land of the original inhabitants. They came here to a country where no one wanted them. That was a long time ago. We all need to get over what happened to our forebears and get on with making this the kind of place where all our children can grow and thrive.

      No idea. But I do know that West was chomping at the bit for her to say yes, LOL. He so wants to discredit this witness. Problem is, she isn’t even close to being the most important witness so far.

      “Was the person on top the one who stood up?” “YES”.

      And there are SO many more witnesses to go.

        MOM also tried to trip Mrs. Mananlo as he kept stating about her going outside! She had to keep telling him that she did not go outside. You have to listen carefully to that pair of idiots who think they are going to win this case by making “liars” out of everyone – the physical and forensic evidence does not lie AND no one lies more than their client and even themselves!

        Rachel’s story is the same story that was told by the many other witnesses of the day!

      As a teacher of students with special needs, I feel for Rachel.To have to sit on a witness stand and be forced to answer questions over and over must be torture for her. I was so angry when West asked her to read that document. She was clearly frustrated after having been told to read it. I feel as though West knows Rachel is learning disabled and is preying on her weakness. This whole “take your time” and standing over her as she reads. I don’t have concrete evidence that she is L.D but from her speech, the way she holds her mouth, and mannerisms, she reminds me of a lot of my learning disabled students. Despite her limitations, I think she did a decent job but she is going to cause the state some points for depicting Martin as a user of derogatory language. It’s already an uphill battle to humanize him in the mind of the jurors due to his skin color and Zimm’s narrative, now the prosecution has to surmount the fact that he referred to Zim as a “Cracker” and “Nigga.”

        Indeed you’re correct however it makes West look cruel to badger this girl who clearly is telling the truth about the good and the bad. What they should take away from her testimony is that Trayvon tried to avoid a conflict with the “creep” while Zimmerman sought out conflict with the “asshole” and “punk” and with a gun to boot.

        They cant make Skittles as bad as a gun no matter how hard they try. Indeed a creep cannot be toppled with Skittles so its best to run and thats what Martin did.

        I agree with you about Rachel, although I’m not positive. I think that she might be LD or mildly Asperger’s or both. It explains things like her being somewhat behind in school, lack of social graces (not trying to make herself look good and not trying to hide her impatience), her cluelessness about the fine points of how the justice system works, and her seeming to get confused easily by West’s questions. To be sure, all of those things have other possible explanations, but it kind of fits.

      Thanks Professor.

      You have said exactly what my mind was speaking to me as Rachel testified. 16, 18 or 19, she is honest about what her conversation with Trayvon was even if we do not like it. She was also raw and honest about the exchange that she heard between Trayvon and his killer. So whether she went to the hospital or Wake, does not change what she has said from day one about Trayvon’s last words. Today, I am going to pray that her Higher Power takes control as West tortures her for another 2 hours with his pointless repeating of the same questions over and over and over again.

      With all that has been said by all witnesses so far – There was no head banging on the sidewalk. They were not witnessed on or near the sidewalk by anyone so far. There was no blood found on the sidewalk.

      Watched HLN shows last night with commentators split on their impression of Dee-Dee. One very insightful person commented that Dee-Dee was being judged by her dialect and her appearance and that was unfair because what she had to say and said consistently was Trayvon said he was being followed.
