Good Morning:

The holidays are stressful for many of us, but we need to remember that they will be extremely difficult for Sybrina Fulton and Tracy Martin. This will be their first Christmas without Trayvon.

Added to each of our burdens, and especially to theirs, is the increasing anger, frustration, and emotional distress caused by the defense strategy to legitimize the defendant’s ludicrous claim of self-defense by appealing to racist fear of Blacks and Black gangsta stereotypes to demonize Trayvon and transform him into someone who deserved to die. But they do not stop at libeling the dead.

There is no honor, dignity or decency to be found in the defense camp.

By their racist supporters, who specialize in infesting websites where they derail peaceful and rational discussion, spew hate-driven false accusations and assassinate the character of anyone who dares to disagree with them, they have waged a no-holds barred war to destroy Sybrina Fulton, Tracy Martin, Benjamin Crump, Natalie Jackson, and an innocent young girl called Dee Dee, whose only “crime” is being Black, Trayvon’s girlfriend, and talking to Trayvon when the defendant attacked him without provocation and abruptly terminated his life in mid-shriek with a single gunshot to the heart.

We must remember to think of their pain this holiday season, instead of our own.

We also must remember that we are not powerless.

Although this case is an abomination, a marathon, and seems never ending, it will end someday.

I do what I do in this sacred place to assure that the story told about this case to generations of the unborn will be about the triumph of justice over racism, of hope over despair, of love over hate.

We will make it better.

There is a light at the end of this long tunnel, my friends, and it’s not an onrushing train.

My wife Rachel posted the video early this morning of Wilson Pickett singing an incomparable soul version of song Hey, Jude, written by Paul McCartney, but credited to Lennon McCartney. According to Wikipedia, McCartney wrote the song to comfort Julian Lennon during his parent’s divorce. Listen closely to the electric slide guitar in the background by a relatively unknown studio musician at the time. His name is Duane Allman. At the end of this song, Pickett and Allman transcend.

We too shall transcend.

    If someone is going to shoot someone else, why do we only hear about the SYG cases where the victim is dead. If someone owns a gun and is in fear for his life, why can he or she not shoot out a knee cap or wrist. Why does it seem it is a shoot-to-kill law, for sure.

    In discussing Tugboats concealed weapons permit, I noticed an extremely poor photocopy of one in evidence. The copy is so bad, I can not determine who owns it, if it IS current, or even if it IS a CWP.

    I would also like to know why, if indeed the gun used that night belongs to his wife because she paid for it, where is Tugboats. Did she pay for the two on the same day and put them both in her name.What are the gun laws regarding the purchase of gun(s). In Canada, a gun itself must be registered in the name of the owner.

    • I don’t believe he had a valid permit to carry a concealed weapon because he did not satisfy all of the requirements for the course and was issued a a full refund. Nevertheless, he had been issued a permit, so he decided to pretend that it was valid. Along with the refunded fee, he should have been and probably was notified that his permit was revoked.

      The State has not filed a carrying concealed without a valid permit charge, but it should, assuming the circumstances that I describe are true.

    This may be off topic but I am irritated beyond common sense with this case. Does Florida have reciprocal discovery rules? I have a very hard time believing that Baez would be able to say he is representing Serino. Where the hell does that become legal. In nothing I have seen as being legal does Serino show he is represented by this asshole. Attorney-client privilege be damned!!

He moved from gospel to R&B when he was around 19, and after signing to Atlantic records he went on to work with Stax/Volt regulars Steve Cropper and Donald “Duck” Dunn, part of a growing number of devoted white musicians who regularly worked with black stars of the day.

      Music is where the color barrier started to fall down quickly in the turbulent days of the civil rights movement. On the radio, no one cared what color your skin was.

    NBC is going to vigorously defend this lawsuit, they are not going to settle, and they state that they disagree with the accusations put forth against them by Cheorge Zimmernuts, and they state they never intentionally went out of their way to harm him, they only reported the shooting death of Trayvon Martin.

    Paragraph 92 of GZ’s complaint alleges:
    “The defendants’ extreme, outrageous, and indefensible misconduct has caused the Plaintiff to fear for his safety and has otherwise made him extremely upset, anxious, scared, and frightened for his life.”

      Since Cheorge Fogenuts is making these claims, would this not mean, he would have to testify in court to all his claims, and be subjected to cross examination, otherwise it is hearsay?

    Professor, I just sent you an email quoting a response I received today on Newsvine from someone in the Zimmerman camp. I do not have a legal background to know if any points made by that poster are legally valid.

    It actually includes two responses. One was a response to my point that the keychain with the flashlight is strong, physical evidence that incriminates George. The other was a response to my question, “Have you written up a good defense for George yet?”

      Freddy said it was really disorganized. I only read the first part of it and too much snake oil for my liking but I am guessing this is Cheorge’s idea and his Zimmernut cult’s idea, since it is really disorganized, much like his self defense story

        There’s the court’s filing fee. The rest is no doubt on contingency. Looking at the complaint, it is geared to encourage settlement. I hope that NBC tells GZ to stick it where the sun doesn’t shine and demand “strict proof thereof” to all of his allegations. Heck! I can answer the complaint for the defendants in about 15 minutes.

        I’m not even a lawyer and I am confident from learning on this blog that I would destroy Cheorge Zimmernuts in court for this lawsuit

        so I agree with Xena

        NBC wont get in trouble as a corporation because it is innocent dissemination and Cheorge Zimmernuts cant prove any of his allegations

        Besides that, he is of no good credibility or character

        I agree that he is actually trying to get them to settle

        I emailed NBC to find out if it is a real complaint

        I honestly feel NBC should just write a letter to have it thrown out on grounds that it is a frivolous lawsuit and Cheorge Zimmernuts is just looking for a payday and he wouldnt be able to pay the countersuit against him anyways. Perhaps his lawyers would have to fess up the countersuit.

        I have sued once before, and yes some lawyers will work on contingency, but it depends on the strength of the case, otherwise they pay the normal $200 to $1000 per hour for the lawyer, or they pay a deposit for the services. From my understanding of American law, NBC can countersue Cheorge, however Cheorge cant even pay the countersue, so I think NBC would ask that his lawyers be able to pay the countersuit, should they lose, because NBC can get damages from a frivolous lawsuit filed on them.

    The new bloody nose pic looks phony but even if it is real, it doesnt prove any prolonged beating…. it proves he may have been hit in the nose once but even then, there is no trace evidence or forensics that prove Trayvon caused the injury because there is no Cheorge Nose DNA or Blood DNA at all on Trayvon’s hands

      Look again. There’s no “bloody nose” in the color pic. released. The nostrils are clear of any bleeding. There’s only a dark splot on the tip of his nose and 2 splots in his moustache

    If there is one or are two positives that should come out of this tragedy it is that Police Departments will have had a wake-up call and take action to adjust behaviours and that the public is again discussing the absurdity of some of the gun laws in the USA.

    It is hoped both of these issues yield positive results.

    However, I do not agree with some comments upstream about Tugboat. He has demonstrated an obvious disrespect for the law and has openly discussed his views. He has demonstrated that same behaviour within the courtroom by lying about money he had and believing he would actually get away with it and disrespecting the judge through his attorney indicating he did not trust the system.

    He has a shady background and has harmed many people, including his own family in the past and will probably continue to do so in the future. Worse yet, he doesn’t care. He was and is finding people who will always clean up his mess and he thrives on it. In short – he uses and abuses.

    He went out on that night as he had done many times before. He is a wolf and finally found a sheep separated from the flock and took the action he had wanted.

    He believes he is right, above the law, and feels he could do a better job at policing his neighbourhood. He likes to be liked and who doesn’t. But he sucks people in and hides his dark side. He has done that in his relationships including close friends. He doesn’t even pay his bills.

    In my opinion, his working in an office would not be enough for him and his personality. It was not what he wanted to do. It was a just a job.

    Even though he could not pass requirements in the legal profession, he knew what he could get away with and loved being a security guard at clubs and parties.

    He was attempting to prove to the community that his services were valuable. I am sure he would have loved nothing more than to have formed his own security company to legally patrol the neighbourhood and be paid for his efforts.

    But, he chose the wrong victim. He chose a victim with a great reputation and with a family who cared. The Florida laws being what they are, had Trayvon Martin had a history of any criminal behaviour, Tugboat would have gotten away with killing and his plans would progress to fruition.

    He is a racist with friends who are worse. I believe this should have been Murder 1. Sorry folks, I still do not believe he acted on his own. In any case, I will be happy if he is off the street.

    As much as his disgusting older brother wants the world to know how close the family is, I do not believe it. I believe the family will have a Christmas just about like any other.

    On the other hand, Christmas for the Martin Fulton family will never be the same. I can only wish them well and soldier on.

    I wonder if they hate the lead detective who didn’t believe Zimmermans story from the get go, but was overruled by those in a higher position in that police dept.
    Funny how some of them think this latest picture “seals the deal” as one put it, and yet the lead detective who saw these ‘injuries” close up wrote his his report he wasn’t convinced of Zimmermans tall tale !

      He’s suing for defamation and intentional infliction of emotional distress, demanding unspecified damages.

      Defamation? GZ said “He looks Black.” Later, without being asked by the dispatcher, GZ said “And he’s Black.”

      Had GZ gave no racial description for Trayvon, he still shot and killed him. His emotional distress is because he killed an unarmed 17yr old, 11th grader.

Even in a highly justifiable homicide, shooters experience a variety of reactions, sooner or later. Most soldiers experiencing warfare come away with some version of PTSD.         I think that it is unlikely that GZ can win this one. But, on the bright side, if he does somehow get money out of NBC (either by winning the lawsuit or by NBC settling with him), it may make it worthwhile for Trayvon’s parents to sue him for wrongful death.

        Cheorge describes the kid as black, I believe 3 times. Once for being asked, and the other two of his very own volition and in the end the statement is still true, he described the kid as black and his teens. On top of that, Cheorge has zero credibility. I could show splices of Cheorge claiming that Trayvon as a kid, and in his teens, and then stating that he knew Trayvon was unarmed, then show his footage from the first bond hearing where he claimed Trayvon was closer to his age and he did not know if he was armed or not.

      Professor – NBC did admit wrongdoing and let two employees go. That shows Tugboat just might have a solid case. That he does this now is more theatre and more fishing for funds. Do you think this case will be successful if in fact he did file one? Or does NBC taking care of it upfront exempt them from further compensation?

      • I guess Xena has checked PACER, and it is not showing yet, but looks like it will be filed.

        My prediction is that this complaint/suit will be moved to Federal Court, where it may likely not be addressed until the entire criminal case is resolved in either 1.) acquittal, wherein there would be no damage and the lawsuit would go away or 2.) conviction, where the lawsuit will not be addressed until the entire appeal process is exhausted in all courts at all levels. And this scenario could take years.

        I don’t know that they admitted wrongdoing – they did admit they did it and I’m not even sure that they stated the 2 employee that were let go were let go specifically because of that, but I can’t remember.

        • There is an evidentiary rule that a defendant’s effort to repair a defect that caused an injury to another is not admissible to prove that the defendant knew the condition was dangerous.

          The reason for this rule is to encourage potential defendants to repair dangerous conditions without fear that the repair would be used against them in a lawsuit.

          Applying this principle to the GZ lawsuit would result in preventing GZ from using the firing as evidence of an admission of wrongdoing by NBC.

          That is but one of many obstacles to the success of the lawsuit.

          Let me say this — in my more than 15 yrs of working in courts and the law, I have NOT ONCE seen a complaint filed that does not begin by stating the rule or statute it is brought under, and the statute(s) allegedly violated. GZ’s complaint, prepared by O’Mara and the Beasley Law Firm, does not set forth a jurisdictional statement until page 8.

          BTW, the Beasley firm, located in PA, is awaiting approval on their pro hac vice applications which means, they are not licensed to practice in the State of Florida and require the court’s approval.

          • The application to appear pro hac vice is standard operating procedure for out of state counsel not licensed to practice in the state where the action was filed. Basically, all that is required for the petition to be granted is a client, of course, a lawyer licensed in the state where the case was filed to sponsor and supervise the out of state lawyer and be the local contact (that’s co-counsel Mark O’Mara), and the lawyer must be admitted to the bar somewhere (Pennsylvania in this case) and be in good standing. Oh, and the out of state lawyer has to pay a fee. When granted, the lawyer is authorized to represent the client and act as his lawyer in that particular case.

            Like Xena, I have never seen a complaint organized this way. I find it disorganized, confusing and not very professional.

        LOL at him claiming a prolonged beating when there is no trace or forensic evidence to prove this (IMO he staged his minor injuries to bolster his self defense claim)

        Cheorge then goes onto claim that it is a grand conspiracy to paint him as a hostile racist

        Lastly, the only fault, if any was found was with the employees responsible for the news piece, and they were already fired, so I dont get what he wants now

        Oh yeah, so him getting around $300,000 is not profiting off a kid’s death but NBC airing the news, like it always does is

In many ways I feel robbed trying to put the pieces together because the police never even snapped a photo of the vehicle, or it’s position, I really don’t know why I should believe that GZ parked where he said he did, drove where he said, or walked where he claimed. Beginning to think he took that vehicle around the back way. Or something.

      At any rate, these time stamp things are going to have to be worked out for every call in the record. In my own legal case, the time stamps from the 911 dispatch differ from the dash cam video and other sources by as much as five minutes.

    The holidays are stressful for many of us, but we need to remember that they will be extremely difficult for Sybrina Fulton and Tracy Martin. This will be their first Christmas without Trayvon.

    This will be my 19th Christmas without my middle son and believe me it doesn’t get any easier. The one consolation I have is to know how, when and why my son passed, which does not compare to the agony the Fulton/Martin Family is suffering while waiting for justice.

    Someone mentioned in a post the other day about sending a card/message to the family with the names of those who continue fighting for Trayvon’s Justice. Has anyone followed up on that suggestion?

      Since October, each month on blackbutterfly7.wordpress.com, I put up a post for encouragement for Trayvon’s family. I understand that Attorney Crump has been notified. This month I will do the same and everyone is welcomed to post a comment of encouragement.

      I do maintain where those not previously posting comments are placed in moderation first. Once approved, comments are then freely released without first going into moderation. This is necessary so the Zidiots will not post insulting, rude, demeaning comments.

      Thank you for sharing your personal experience, and sympathy to you, this season. And no, life never gets “better” and the concept of “closure” is absurd. It’s different. It’s a life before and a life after, and I am sorry to hear that you went through this. Losing a child is terrible and wrong.

        BTW, I very much appreciated a statement you made on December 4, 2012 at 3:36 pm in the “Featuring Lonnie Starr” article:

        “Trayvon Martin did everything right and everything that we teach our children when approached by a stranger. Run and if needed fight back.”

        It was a refreshing recognition and affirmation of Trayvon’s personal dignity – particularly in contrast to Lonnie’s theory, which relies heavily on his assumption that Trayvon was “extremely childish far beyond his years” – apparently as “evidenced” by Lonnie’s own characterization of Trayvon as “a whining, crying child asking for his momma” (while looking down the barrel of a gun aimed at him).

        [AS IF a “real” barely-seventeen-year-old would have … done WHAT? Left the “momma” part out? Would that have been “mature” enough? “Taken it like a man”? WHAT?]

        Lonnie’s theory as revealed in defense of his theory and in multiple postings in the preceding “Tempest in a Teapot” article are chock full of gratuitously insulting characterizations of Trayvon.

        So I applaud and thank you for your above-referenced statement.

    Just thought of a good way to make money on the blog: Print up a few thousand bumper stickers that say: “DO NOT GO TO FLORIDA; STAND YOUR GROUND ELSEWHERE.” Sell them for $5 each plus shipping and handling. In January I can chip in about $50 for the first printing.

        • Okay, so I am not crazy. We live in Kentucky in what’s technically called the mid-south, I guess. Just an observation: Many people feel strongly that they like to carry their guns. There’s got to be some courses or something that people take, you know, that teach that gunning down a little old lady at a gas station is not a reason to pull the thing out and start firing. I know of responsible gun owners who carry and they would never endorse such crazy behavior.

        Yes, exactly. I think we’re seeing many, many concrete examples why background checks and education must accompany gun ownership. Not to mention needing to take a real hard look at how our society’s self-defense laws work. In many countries in the world, one cannot respond with any type of a physical weapon if someone harms you with their fist. These countries not only have far less gun murders, they have far less murder per population size period. The rules of engagement need to be held to a stricter standard.

        I think we’re also seeing what happens when times are hard – these incidents are symptomatic of systemic collapse. The loose cannons of our society go off first when the going is rough.           My thoughts exactly. Scary to think if Trayvon had had someone with him it could have been two and not one. There was also a kid close by walking a dog. Even if the theft problem were real, and I believe it was exaggerated, one would call the police, the police would arrive, recover the whatever and make the arrest and nobody would be hurt in the least. FWIW, I have known a couple of cat burglars. These people are not violent. Plus, in general, they shy away from dogs, believe it or not.

          From what I have seen, GZ never completed the required course for the carry in the first place. Unless he has produced a valid and current permit, he was not acting lawfully carrying a handgun that night.

            Sorry I was in a hurry and did not complete my thoughts (even though you seemed to understand). I have insurance on my car but only licensed drivers are covered. If I loan my car to a known unlicensed driver, I am liable for damages if that unlicensed driver is in an accident and the insurance does not cover it. I don’t know if I would be criminally liable.

            So if ShelLIE gave a gun that was licensed/owned by her to an unlicensed person (Chorge) is she liable for damages, either from a criminal standpoint or a civil standpoint..

            Stay with me here, you go to jail for not having car insurance but if you don’t have a valid permit to carry and you kill someone, simply claim, “I had to do it,” and you do not go to jail, or get a blood test, or any sort of verification at all.         i have an issue with that part of your statement.
        #1. Gz has NO authority to protect or improve anything at THE gated community he RENTED in ( where he barely paid the rent). There was no onslaught of crimes anyway. And even if there was, it wasn’t ANY OF HIS BUISNESS! That’s why we pay taxes that pay trained police officers.
        And he KNEW THIS! That’s why he kept trying to get into law enforcement. And he knew WHY he never could never be a police. He was told, and warned and he didn’t give a shit!

        #2.He didn’t do ONE thing out of CONCERN for anyone in that neighborhood. Instead he did everything he could to harass the people who didn’t appreciate his bullshit! Trust me, the people he harassed KNEW what time it was with GZ. And GZ knew that too. He knew the ones who saw through his condescending, passive aggressive, fake ass intimidation tactics were a problem and so he harassed them even more for it!

        #3. And don’t forget, gz did learn what he wanted to during all those classes he failed repeatedly. He learned all about the laws he wanted to break when they became inconvenient for him. He also practiced his shot with a former policeman. Its fair to assume he learned plenty of other evil tricks from Osteman too. He also apparently was so obsessed with another policeman’s ‘justified kill’ he would drill him for every single detail. No doubt making notes on using some of that info in his own box of tricks to be used later!

        No, this guy has no redeeming qualities to commend. He’s not only a child molester,a liar, thief and scam artist, he’s now a killer! He got to where he’s at today from years of practicing his craft on who knows, all kinds of victims, with impunity!

        He’s the one who kept getting away with it!

        I think you’re right Shannon in that GZs motivation to help his community was twisted in the direction of self-glorification, and one reason I said that many people lack the emotional stability to own firearms. Studies show that people who carry often tend to become more, not less aggressive. They tend to rush into situations they would avoid without firearms. They even drive more aggressively on highways. It takes a really cool and mature head to handle firearm ownership. And the most responsible gun owners likely don’t carry them everywhere, either.

        • One of my siblings is a gun collector and expert marksman who is licensed to carry. He is extremely obsessed with safety, and he has a gun safe so that they are never just lying about. He has never pulled a gun on anyone in his life. If people are going to carry, they need to be mentally stable, extremely proficient with the safety and workings, and it seems to me that when people get to this level they rarely if ever pull their guns outside of a shooting range. I don’t think Mr. “It Was The Gun” was safe to handle this responsibly. At all.

      OMG how psychotic! I’m lucky to be alive I guess. One time I was turning right onto a roadway and a woman in a wheelchair came up on my right before I turned and appeared to have been hit by my car. That is, I heard metal clank just as I saw her wheelchair and stopped my turn. I then put the car in neutral and pulled the parking break and leaped out the driver’s side door and ran up to her to apologize and give first-aid. She was pulling away from me rapidly and when I approached she began to scream at me so I got disoriented. I apologized and asked if she was OK and she started to cuss me out for being IN HER WAY, which at that point I actually was, because I wanted to see if she was hurt. “Get the bleep out of my bleepin’ way!” she screamed at me, “What the bleep is wrong with you!” and she sped across the street against the light and vanished. I pulled in to a parking lot and called 911, giving details on where she was headed and telling them I thought I had hit her. They said I obviously had not hit her and wouldn’t take the report!

      A friend of mine said, “You will never have good luck again in your life; you just used up your whole allotment of good luck in one minute!”

      First I thought that was funny. NOW I don’t think that’s funny any more. I now think I’m lucky the old lady didn’t shoot me in the chest with a 38! I probably HAVE used up my luck! 😈

    You are speaking of a rational world but all they need is one holdout for jury nullification. The Anthony and OJ trials are examples of high profile nullifications but there are,no doubt, others. He will never be allowed to have a life even if found not guilty, though.They will get him in the end, I’m sure of that. I take comfort from that….and I still have hope Shelly will realize she can have a life. What she knows will seal his fate even against the possible racist juror.

      2-D, I don’t think there’s going to be a jury nullification in this case. It’s not that I have too much faith in humanity; it’s just that the signs are not strong enough for that. One of the reasons the signs are NOT strong enough is that somehow the combined personalities of Trayvon Martin, Sybrina Fulton, Tracy Martin, Crump, Jackson et al. have been creating a different environment than we have previously seen in a case like this. It is all bad luck and good luck together.

      • Interesting, I did not follow Anthony, but I did follow OJ because I lived in LA at that time. I remember being very shocked. Unfortunately, nothing in the courts shocks me anymore. I hope you are right.

        Malisha , very profound statement!! I really get disheartened when people compare A case to B case=gz case. And these potted plants don’t have anything to do with trayvon B Martin case. Only connection now is serinos lawyer and they will keep each other in check with no comment until the trial if it gets that far. I support singleton and serinos investigation techniques to get fActs and fairy tales to fogens fairy tale of a crime. Scapegoats are a dime a dozen in the 21st century ., how can you make a merry Christmas out of this tragic affair?

      He’s an asshole, for lack of better word. He should have been arrested and tried for other crimes a long time ago, such as stalking, molestation, rape, cruelty to animals, harassment, making threats, perjury, contempt, etc, and now for stalking, terrorizing, threatening, and murdering a kid

      Plus, his disrespect and lies of a dead kid… that will angry a jury and a judge,,, I could send my screenprints of Cheorge’s cults attempted intimidation of witnesses, and their racist hate toward a dead kid who did nothing at all to him

      so in conclusion, screw Cheorge Zimmerman, I hope he goes to hell, I hope his karma catches up to him and he is locked up for the rest of his life, and now all his victims can get some peace and justice and this dirtbag will finally see in prison how it feels when the other inmates give him the same treatment he has given others

      I have only followed two cases before this one – OJ s and Anthony’s. Both outcomes were surprising and disappointing to me. It is hoped this one will be different and there will be Justice for Trayvon.

I continue to believe that we and everyone that supports justice for Trayvon will see the light at the end of this very dark tunnel we are traveling together. My prayers go out to the Martin/Fulton family everday. My hope is that the outpouring support for Martin/Fulton family will help them in some small way to get through this first Christmas without their child.
