Zimmerman: Judge Nelson Denies State’s Motion for Gag Order

Important Announcement

NBC News in Miami announced that Judge Nelson issued an order this afternoon denying the State’s Motion for a Gag Order. She said it was not necessary at this time.

By separate order also issued today:

The trial is scheduled to begin June 10, 2013. In a separate order Monday, Nelson said that final witness lists, including any expected expert witnesses, should be exchanged by March 27.

Any self-defense immunity or Stand Your Ground motion should be filed and heard by April 26, and any other pretrial motions should be filed and heard by May 10, which is 31 days before the trial, Nelson wrote.

The next hearing in the case is Dec. 11 at 9 a.m

Hopefully, there will be more information about this later.

I came out of that reply box and am commenting here separately. The next time you sign-in make sure you are not putting your email address in the second line of the sign-in box. In the event you didn’t, then you might want the Professor to know that this happened.

    Exactly….That was a rapper as I recall in MA and I saw where he went public telling the Zidiots to stop using his images as Trayvon Martin, who was murdered. The Zidiots used another Trayvon Martin that one of them found and you can tell it is not the same Trayvon by the width of his nose and the tattoo’s.

    The pic of the teen flipping off at the camera is not Trayvon either. There is a physical difference. The Zidiots believe that all Blacks look alike, with the exception of Bill Cosby.

    I have a question for Lonnie Star, or anyone else who can answer, regarding a project I’m working on.

    The Clubhouse videos intrigue me, but frankly give me a headache trying to understand what they are showing. I’m aware of very impressive work done by others in sorting through all the vids, but how are they assigning clock times to what the vids show or indicate?

    Am I missing something? I’m aware of the LE document saying they are 18 minutes out of sync from real time, but what translates that info to a specific time at any point in the videos?

      The time on the tapes are 18 minutes slow. Trent Sawyer discusses how he determined that.

        Look at Moron O’ Mara and the Zidiot Nation……O’ Mara has yet to provide any discovery at all and the Zidiot Nation just attacks Crump, Corey, Dee Dee and anyone else they fell like bashing, as if majoring in the minors breaks the case !! Fools, one and all. Then there is the Conservative Outhouse where Trayvon now has at least 50 years of crimes under his belt. I think he was blamed for some robbery in Oakland CA. in 1982 as I recall the Outhouse stating.

        I have to say, my hat is off to all who champion this cause with honest passion & integrity.

          Yes!! There are a few Zidiots who have produced vids, but they are all about what Trayvon purportedly did, such as the clairvoyant, doubled-back conspiracy. They forget that GZ is awaiting trial for 2nd degree murder and not Trayvon Martin.

          Words cannot express how much I appreciate the time and work that LLMPapa, Trent Sawyer, and Teeslaw have put into presenting EVIDENCE via video.

            For S’s & Giggles I went on the gzlegal site…..Are they kidding?? or what. Is it actually possible for someone who claims to be a lawyer to talk out of 9 or 10 sides of his mouth at the same time ?

            It’s not in Mr. Zimmermans best interest for us to talk about the case but …………..(insert 7 paragraphs about his innocence here, and state “undisputed” several times) Is this guy insane ? Exactly as the Professor states, Moron O’ Mara tells the story as if Z was just minding his business and Bam !! out of the blue…..

            More hateable is an understatement.

    I think Nelson did a good thing. MOM can’t have it both ways. I think he will ask for a change of venue,but you can’t be as public as MOM has been and then say his client can’t get a fair trial. I think judge Nelson knows what’s she ‘s dealing with. This will backfire on MOM!

    I wonder if there is any possibility of entering “amicus curiae briefs” in the trial court in Florida. If so, this point would well be made directly to the judge since I do not believe the prosecution will make it. What it shows ME is that o’Mara is willing to perpetrate what amounts to fraud on the court, and BDLR is willing to permit that. Not that I think it will ultimately matter because I believe this case is too clear for the prosecution’s ass-kissing behavior to the defense to ultimately matter; but if you think of it, something like this would have resulted in a veritable volcano of protest by O’Mara if the prosecution had pulled it.

    Ultimately this last hearing was good in another way: the thing that would make it MOST EASILY POSSIBLE for the defense to get away with a plea to a little tiny cosmetic charge and a slap on the wrist (without wrist control) for George would have been dead silence for all the months until trial was scheduled. THAT would have meant that the path was clear for a quiet little deal. ANY action in the case and ANY news articles in the case, whether they are seen as the defense justifiably doing its work or the prosecution being silly and mean or anything else is still keeping the story alive in the media, and so long as the story is still alive when the time comes for a plea, there will be too much pressure out there for O’Mara and West to go into a proverbial smoke-filled room and save George’s sorry ass without anybody noticing.

    During the hearing to discuss the gag order, MOM provided evidence to Judge Nelson to show the copies of evidence photos he received B&W and colour. He wanted to show the poor quality, etc., etc.

    At this same hearing, MOM provided evidence to the judge a sampling of the gzlegalcase site and several newspaper articles:

    Has anyone else noticed an important omission.

    When OMara entered his motion for sequestration, he included the same of the officer interviewed that caused him to enter the motion or demand or whatever it was.

    That document was shown and discussed on the gzlegalcase website. Funny thing though, before the judges decision to deny his request, that particular document and the discussion – poof – disappeared from the site.

    So, on the 26th, he enters this package to the judge sans this important topic on the site — IMO the most important document for gagging him or at least taking down the site.

    The state did not object to the package from MOM. They maybe did not notice the important omissions.

    In short, there are gzlegalcase topics purposely omitted from MOMs evidence to show that he DID NOT cross the line.

    I think this is important and the State Attorney’s Office SHOULD bring this information to the attention of the court. The omissions may have been enough to have changed the Order.

      Grahase, I believe the gzlegalcase sampling and the newspaper articles were Prosecution exhibits for its gag order motion; and the photos were Defense exhibits for one of its discovery motions.

      The exhibits list document is a bit confusing, but if you look on the first page it describes which exhibits are from which party. (And then from the Court’s minutes, you can see references to when and why the exhibits were submitted during the hearing.)

        How about the lil 6 year old boy that Zimmerman chased home and accused of stealing his bike? The cops concluded that Zimmerman was wrong, yet again, and the bike wasnt stolen… if I was the father in that situation, the cops would be peeling my hands off Zimmerman’s throat strangling him

        It wasn’t a 6-year-old boy, it was a teenager. I think I linked it somewhere – but it was a teenager who always felt like GZ was kinda after him. Anyway, he had to prove to police it was his bike and GZ never even said he was sorry.

        The incident with a boy was a boy who GZ said looked to be 7-9 and he reported him for walking alone down a street toward a school and he was “concerned” because the boy was walking alone on a busy street.

        Gah!!! A 7-9 year-old boy – walking toward a school. It wasn’t like he was 4. Concerned my ass.

Since Trayvon had superhuman ability to know that if he ran, GZ would follow him; where GZ would run or walk after Trayvon became invisible, and the time and place GZ would walk back for him to become visible again, Trayvon was also suppose to be able to read GZ’s mind to know who he was.

          You see, it’s all Trayvon’s fault for not being 100 percent clairvoyant.

    On Sept. 15th and 16th, 2012, Gravis Marketing conducted a poll of 1,728 Florida voters regarding the George Zimmerman case.

    Of those polled believing GZ is guilty;
    38.5% of Hispanics
    40.5% of Asians
    28.3% of Whites
    57.9% of Blacks
    34.8% Other

    Of those unsure:
    34.3% White
    15.3% Black
    29.1 Hispanic
    35.1% Asian
    40.2% Other

    1,728 people is certainly not many, but it does tell us that O’Mara’s social media presence has not had great persuasion.

          Indeed, GZ made efforts to follow and capture a “suspect.” Some people polled may not have heard his NEN call. Others may have, but assumed that “neighborhood watch captain” gave him authority to get out of his vehicle, chase and confront Trayvon.

          Placing this in the perspective of a parent, any grown man who follows anyone of any age, race or gender, then get out of that vehicle when reaching a road cut-off to follow on foot, and when having opportunity to de-escalate the situation by introducing himself but doesn’t, should have the living daylights beaten out of him.

          Rather than crying for help, GZ should have been yelling “I’m neighborhood watch, I’m neighborhood watch, please stop beating me.” Well, Trayvon never laid a hand on GZ because if GZ was doing the right thing, he would have been yelling that he was neighborhood watch so residents would have courage to help him. Not even the residents had a clue who GZ was. Why choose to help him rather than Trayvon?

        Why would they feel a Neighborhood Watch is allowed to target, stalk, and chase people for walking down the street?

        The guy does not even have any evidence of a crime being committed while he chased and stalked and, or any reasonable belief for suspicion, nor is there any empathy toward how a kid would feel about a complete unidentified stranger, stalking and chasing him throughout the dark of the night with a gun, when he was just walking home with Skittles and Ice Tea.

        Even cops identify themselves before giving chase and have a system in place before they are even allowed to go after anyone, which Zimmerman has absolutely zero authority to do at all (act as an officer)!

        I dont care if it was an adult, no one wants to be stalked and chased by a complete stranger, who has crazy perceptions about, chasing them around a complex with a gun, accusing them of doing burglaries, especially a person who is not even a cop or authorized by law to do so. We dont live in anarchy or a police state. Especially if you are just walking home with candy.

      That means that they believe he is guilty NOW, before the prosecution puts on its case. Remember, most people in a poll before a trial even starts will say they do not know, especially if they are in the state where the trial will take place. To say otherwise is to make it seem that the person can never get a fair trial. If you asked the same people, “Was it proper that George Zimmerman was CHARGED?” they would show much different numbers.

    About the screams and about George saying, as soon as he was cuffed (IF we are to believe the police report saying he DID in fact say this while being cuffed and placed in the squad car) that he was calling out for help and nobody would help, there is this to consider:

    1. George claimed he was the one screaming “Help me help me”
    2. Two forensic voice identification experts said that it was NOT George’s voice, using examples they had of George’s voice, and mapping it out (one using a computer program and the other, his trained ears);
    3. The FBI did not say it could not be George’s voice or that it COULD be George’s voice; all they said was that they could not tell WHO it was. Not being able to tell WHO it was does not tell us whether they could rule OUT George. I’ll be they CAN but didn’t want to say so yet.

    Anyway, there we have a credibility issue of George testifies.

      Robert Jr & Sr can get up on the podium and continuously lie but I dont feel they are convincing any impartial judge or jury that that is George screaming

      1) It does not sound like George
      2) They can use the voice samples George gave to compare the two
      3) It sounds like a kid screaming and George screaming at the kid
      4) The screams were ended and stopped with a gunshot
      5) The screaming does not match Zimmerman’s story
      6) I would moreso feel they will believe Sybrina over the Zimmerthugs regarding the screaming
      7) There are 4 witnesses who stated that it sounded like a kid, who were at the scene
      8) Zimmerman was the one targeting and chasing the kid with a gun. The kid was running away from him. The kid was smaller than Zimmerman and was unarmed and only had Skittles & Ice tea. It is obvious who was the one in fear for their life, the one who was about to die, which was Trayvon.
      9) I would show voice samples of Zimmerman talking and what he sounds like, such as the NEN call and some court tapes.

      Personally, I feel both the Roberts should get perjury and obstruction charges when they step in the ring called court, because that is really f***ked up to listen to that kid scream for his life and lie like that

        According to this definition, if Zimmerman killed Martin in self-defense, he must prove that force was needed to prevent his own death. It doesn’t even say anything regarding “great bodily harm”. I assume standard self-defense laws vary from state to state.

        There’s way too many points for Zimmerman to fall on the actual statute and its fairly far from a self defense claim because Zimmerman targeted a person and started the altercation, as well, he was in no danger, at all, and the victim had given up a long time ago by running away from him, trying to get away, and screaming for mercy. On top, he lunged at the kid after shooting him, pinned him down asphyxiating him by sitting on the kid’s back while he was facedown, and started rubbing his hands all over the dying kid. Its not self defense if you start it. There’s an attacker/aggressor, and then there is the defender.

        I don’t know about standard self-defense laws, but the SYG law has a specific set of provisions for if the accused is determined to be the aggressor. If they are determined to be the aggressor, the person must attempt to flee and also show the other parties involved that they are no longer going to continue to use force. It would have been possible for Zimmerman to be acquitted on standard self-defense charges, that is if the prosecution didn’t have the evidence like Martin screaming before being shot. The tapes of the screams seal it for Zimmerman. He shot an innocent kid that was screaming for his life, and nobody would help him, not even that neighbor that came outside. If I heard some kid being assaulted and screaming for his life outside of my home I would be out there in a second with either my gun or a baseball bat. So typical of people today thinking that the police will protect them.

      Didn’t you know? Mama Zim comes from a Peruvian cult that sacrifices goats on the full moon. GZ’s required participation in that ritual was a programming where he simply has to be touched on the shoulder to engage violent behavior, which he forgets upon drinking water. (Remember, he consistently asked for water in the police station that night, and also before the voice stress test.)

      Mama Zim’s ability to program her children via the Peruvian goat sacrifice ritual is the real cause for GZ being a failure, now followed by the rest of his siblings, and her own situation of living like a vagabond, because the last goat she sacrificed was a day before a full moon. It’s the revenge of the goats.

      • @Rachael…..Exactly. That’s why Trayvon’s parents set up a petition on change.org to force the SPD to do an investigation. Whenever there is a case, where I believe there has been an injustice, I google the “victim’s” name along with the word “petition”, and I usually find one to sign. It puts pressure on the “powers that be”, and lets them know that the world is watching. It seems like a small thing but, it can make a big difference! (I’ve been signing and have worked getting signatures for petitions since the Viet Nam war and the first Earth Day…..and still signing away….lol)

    I just checked my YouTube account, and sometime this week I should reach a milestone for my message about Trayvon Martin of 100,000 views. I’m not naïve enough to think all viewers agree with, or support, my beliefs regarding what happened on February 26, 2012.

    To that end I make the following offer to Attorney Mark O’Mara or ANY supporter of George Zimmerman.

    Surely some of you have a video camera and the fundamental skills to post a video to YouTube. Instead of screaming about race, the media, Ben Crump, or Natalie Jackson, produce a video with a 5’8” tall 204 lb male lying on his back, prone in the grass.

    -Have a 5’11” tall, 158 lb male straddle him in the “mounted” position with his butt on his stomach and knees against his chest.

    -Put a plastic “gun” in an IWB holster in the dude on the bottom’s pants.

    -Have the one on the bottom “shimmy” his ass off as hard as he can, while the person on top has one hand on his nose and the other on his mouth with his full weight.

    With no IMO, JHMO, or MOO verbiage, show me these three things:

    (1) How it’s remotely possible for the one on top to ever see the “gun”.

    (2) How it’s remotely possible for the one on the bottom to reach and draw the “gun”.

    (3) How it’s possible, with the “gun” drawn, to position it in such a way that a bullet could be fired from an INTERMEDIATE distance, to pass through a victim’s heart DIRECTLY from front to rear with NO angular trajectory, 17 ½” down from the top of the head of the person on top.

    It should be easy, shouldn’t it? George has already provided the script that must be followed!

    Show me these three things are possible, and I will instantly delete all videos on my YouTube channel about Trayvon Martin. But you know what? I’ve got a feeling you’re gonna just keep whining about poor innocent George, and I’m gonna keep picking away at his lies.

          At Friday’s hearing, Bernie said that the FBI’s investigation is ongoing. Judge Nelson told MOM (my paraphrase), that if he wants anything from the FBI, to get it himself.

          The FBI might take a year building a case to make sure they have all evidence necessary to get a conviction. They work smart; not fast.

      I’ve seen most of your videos but the one that sticks out to me the most is your theory referring to the height of GZ and TM and how when GZ’s arm is extended straight forward from the shoulder, it aligns perfectly with TM’s chest and the entry of the gunshot wound.       Zimmerman is heard stalking the kid and clearly admits to it, and admits that the kid is running away, 3 times. Zimmerman is actually heard getting out of his car and running after the kid.

      Screams are heard that sound like a kid, the same kid Zimmerman was stalking and chasing with a gun. Zimmerman has killed the kid. Zimmerman is far away from his car. In the time frame a slotted, he should have been back at his car if that was his intent. Zimmerman is instead found at the dying kid he targeted, having had killed him.

      What rush to judgements when it is fact?

The one I wanted to post was a HuffPo article that amazingly enough is no longer available, but I found 2 others that mentioned the people concerned, but I see the context was already mentioned here about the young people afraid to go out of their houses because he made them feel like they were being “watched,”

If those complaints that had been made against George Zimmerman had been followed up on, as they should have been, because the police are a PUBLIC SAFETY agency, then they would have prevented the killing of Trayvon Martin. Goerge Z would have been put on notice that his conduct of chasing people around and threatening them with guns and profiling young Black males was noticed, was not OK, and would not be permitted. THEN he would have been afraid to chase down Trayvon and kill him. In that regard, the SPD HAD TO COVER UP THE CRIME because they had already had reports of the dangerous activities George was engaged in that made all the neighbors vulnerable and that made it quite probable that there would be an untoward incident resulting in injury or death.

        On March 1, 2012, three days after the killing of Trayvon Martin, Bill Lee went with “a member of the city council” — that would probably be Commissioner Patty Mahaney — to a meeting of the RTL HOA, and a home-owner had to be “escorted out of the meeting” because he was getting vocal about the fact that his several complaints ABOUT ZIMMERMAN to the police prior to the killing of Trayvon Martin had been ignored. So the complainer, who had already notified the police of the clear and present danger to his community, was escorted out of the meeting and intimidated by the police chief and the city counsel member.

        See what their incentive was to cover up this crime? THEY WERE COMPLICIT IN THIS CRIME.

          There’s a blogger who argues a “bigger picture” about the situations leading up to, and allowing GZ to harass residents, and it involves blaming minorities who moved into that gated community for the housing crash that reduced the property values.

          Noah Caraker, an administrative employee of the Seminole County Public Schools and HOA President agreed to pay the SPD to conduct patrols in the community for traffic and HOA violations. That agreement was announced in the June 2011 HOA newsletter, which is part of discovery.

          On September 20, 2011, Noah Caraker formally stepped down as HOA president and 2 days later on September 22, 2011, George Zimmerman was introduced at the community meeting for NW. The president replacing Caraker was not aware that GZ was trying to organize a NW until residents called him about a man coming to their door with a clipboard.

          If I remember the chronological order of events correctly, after GZ made contact with Dorvial to address residents about NW, Taaffe gave her a call (documented in an email by Dorvial), complaining about renters being the problem for crime. Dorvial asked GZ if the HOA had policies for homeowners renting out their property, such as conducting background checks. GZ, himself a renter, did not get back to Dorvial with that info.

          Based on the blogger’s argument, the intent of Caraker was to have the SPD harass or give an appearance of intimidation to certain residents of the RATL, namely, Blacks, to encourage them to move out. Taaffe has given the public the impression that race is the basis for his justification for GZ to profile and kill Trayvon.

          What the SPD could not do without exposing themselves to complaints of racial profiling, GZ could do, and the handling of any complaints would be left up to the HOA because racial profiling and harassment by an undeputized nobody is not a crime — they have no authority to wrongfully enforce any laws that violate human rights.

I mean yes, something should have been done about him earlier, it is obvious he was a shooting waiting to happen, but that does not change the fact that HE, GEORGE ZIMMERMAN did what he did. That does NOT change the fact that GZ was the one holding “the” gun leaving a young man’s body dead on the ground.

        They may have been complicit in this crime, but that is a separate issue and does not change the fact that GZ murdered a young man.

        That is like the outhouse folks saying that if Trayvon was doing okay in his life, he wouldn’t have been sent to stay with his dad and therefore, would not have even been there that night. Whether it is true or not that he was having problems, that has nothing to do with the fact that he was there that night and GZ shot and killed him.

          Thanks for the link, Rachael. I remember reading that some months ago. It did encourage me to listen/watch Taaffe’s interview with Nancy Grace. Now, to be honest, I am not a fan of Nancy Grace, so this is the first time I’ve actually watched that interview. What I heard is that Taaffe talked with Osterman. Osterman presented GZ as a deputized member of LE and Taaffe was stupid enough to repeat that type of defense. Taaffe also rudely interrupted everyone with the “injuries” line of jive in effort to avoid addressing that GZ was the aggressor.

          IMO, Taaffe has the White Superiority disease thinking that his race and gender makes him right, even when he is wrong.

      1. That GZ wanted employment as a cop but did not qualify, and;

    Try to get not to get too excited. Who tells you there is not money flowing indirectly too? Who pays West? Is he working pro bono too? Are there other people involved, a PR advisor? Who pays them? O’Mara?

    When I came to the case rather late in time, it was centrally the phrase: There will be money enough for Zimmerman’s defense, that startled me. It sounded like a threat aimed at the Zimmerman skeptics. They got banned, the most racist comments not. This is a recurring phenomenon from my perspective on Jeralyn Merrit’s Talk Left.

    When the prison calls became public the blog owner, that wrote the sentence above, a retired military intelligence man, and former Green Beret somehow backtracked. The state should collect all the money and give Zimmerman a new bond, he suggested.

    Was he disappointed by George’s attempts to play the system, somehow thought he should be punished for what he did, at least concerning the underhanded handling of the money flows? Or did he only indirectly suggest from now on some support money should flow more discretely and more directly to the lawyers? How many NRA members in the US are there, what does this case mean for them?

      The only way to run a corrupt agency like the SPD is to have a solid inner core of corrupt employees (in this case officers) whom you can use to keep the others in line. According to RTL home-owner Ibrahim Rashada, a young Black man with a pregnant wife (at the time of the interview), he would not even walk around his neighborhood because George had been publicizing the fact that he wanted all the neighbors to suspect and profile young Black males who, he said, were burglarizing the neighborhood and endangering all the residents. Rashada said that when he wanted to stretch his legs he would drive downtown to walk around but he “didn’t want to be chased” within his community. Will all of the evidence released, they continue to focus on everything else besides evidence.

            When someone said that Trayvon had none of GZ’s DNA or blood on his hands because of the rain, I felt as though that person was a 6 yr old. Their arguments actually work against GZ’s defense because if it was raining sufficient to wash Trayvon’s hands clean (who was dead and not moving), then the same rain should have washed GZ’s head clean too, and even more so because he was walking around. .

The other day I read a Zidiot who thinks that the Exhibit list for the 10/26 hearing on the docket was the list of those present when attorney Crump interviewed DeeDee by phone. Other Zidiots agreed and then argued that attorney Crump was in violation of the court order that he provide the list by 10/29 and he was late.

            Now, if people don’t understand that 10/26 is earlier than 10/29, neither have knowledge to understand that an Exhibit list consists of exhibits entered at the hearing for that date, what can we expect in terms of serious, mature debate?

        Yahoo comments is one of those venues that allows for thumbs up and down. The Zimmerthugs don’t play fair. In April, there might be 3 thumbs up or down at the most for comments. It takes about 9 thumbs down to hide a comment, and around May, the Zimmerthugs began hiding pro-Trayvon comments. Someone began hiding comments made by the Zimmerthugs, and along came one of them with at least 35 different accounts and he openly brags about it.

        On wordpress, unless the administrator requires those posting comments to be registered with wordpress, they can use fake email addresses and change their handle as many times as they use the fake email addresses. I know one treeslummer posted comments to my blog from the same IP address using fake email addresses, and the handles she used are all posted on the treeslum. She even posts comments to her comments using different handles. LOL.

          It is because they are afraid of equality. Their most recent conspiracy theory that GZ was arrested due to racism by Blacks is because they are afraid of equality. When attorney Crump hit the media with the story, Rev. Sharpton presented the story on his MSNBC program, and peaceful marches were organized, racial bigots see that as Blacks having too much power.

          The racist bigots, in their fear that Blacks have too much power, avoid addressing an important detail about this matter; i.e., that the SPD refused to cooperate with Trayvon’s parents and release the police reports and recordings of the 911 calls. Had the SPD at least done that much, it would have given the appearance that they believed, and stood by, their decision not to arrest GZ. The SPD effectively conveyed that their word was good enough and the parents of the dead teen had no right to know how they came to their conclusion not to arrest GZ.

          It took all that Trayvon’s parents did, and all the people involved, to force the SPD to release information that effectively, shocked the world. There is no way anyone can listen to GZ’s NEN call with the profanity, name calling, and his taking of unofficial authority to follow Trayvon after Trayvon ran from him, and not come to the logical conclusion that GZ is the cause and effect of his own problems thereafter and should have been arrested.

        The only proof positive I see in how the case has turned out is that Corey was fairly thorough with her team and they have a lot of evidence against Zimmerthug. Nelson already stated she would do her darndest to get an impartial jury on. I doubt a judge or jury is going to believe Zimmerthug over everyone else. The fact of the matter is Zimmerthug gave away the biggest evidence against himself, which is his NEN phone call to police. His statement also makes him look like an idiot because that car circling disappearing act and T intersection address nonsense is ridiculous, especially since witnesses can give the movements better and a few witnesses have stated that they were moving north up the back pathway toward the T intersection. Add that with the screaming and the forensics, I doubt Zimmerman and Omara’s conspiracy Conservative Tinfoil Hat nonsense is more believable than the witnesses and the evidence.

    Regarding the good Judges decision to deny the gag order. Zimmerman and OMara is using the social media platform to raise funds for Zimmermans defence and living expenses (and Shellies legal issues, lest we forget). Had she gagged them, the cash tap would stop flowing. As a result, GZ would become a burden upon the State for those same expenses. I think she had to consider the monetary aspect in her decision. Better he pays his own bills.

      1) The issue can be raised again and she felt it wasnt appropriate at this time

      2) The judge never stated that Omara didnt say anything questionable, she just said he wasnt overriding and I think Omara gets the idea and is gonna watch his actions and speech from now on

      3) She made sure to address the right to have a public court

      4) She addressed that they will go to various lengths to have a fair impartial jury that will strictly weigh the trial by the evidence and not hearsay (which is 99% of Zimmerman’s evidence)

      She doesnt seem to have taken care of the school records yet, but she agreed to treat the school records with the same privacy as the medical records so Trayvon’s records will be safe I think

      I heard Zimmerman scrubbed his myspace and social profiles LOL

I noticed, re-listening to all his interviews, where he is answering questions, that he does a very strange, very not-so-smart, very immature sounding thing when he is questioned. He answers the question as if it, that one question, is all that needs to be answered to make the overall impression that he desires. So they ask him if, when he was punched, he fell down right away. He thinks, “I was hurt very bad and my nose was broken and it was all undeserved and it was all wrong and bad so,” and he answers, “Yes ma’am, I fell down right away.” He thinks, “I have taken care of this issue. Now, since I fell down right away, she sees undeniably that I was hurt very bad and my nose was broken and it was all undeserved and it was all wrong and bad.” He does NOT think, “well, what would I have done if punched in the nose right there at that place, in view of the fact that I shot the guy 40 feet beyond that point,” because he is not paying attention to the big picture, to giving a coherent story that is not just a string of little “poor me” sound bytes; he is paying attention to creating in the questioner, at that very moment, an impression he thinks he can convey by saying any old thing.

        He cannot pay attention to the whole situation even to make up a story that might seem halfway possible. As LLMPapa says, “You can’t fix stupid.” But it’s more than that. You can’t drain the arrogance out of George and make him pay attention to something larger than how he feels at a given momentary point in time when he thinks he can manipulate the person he needs to get what he wants.

        So he’s an inefficient liar.

          Something that has bothered me, but I can’t put my finger on it. When GZ was giving directions, he sounded condescending as though it was Sean’s fault that GZ could not give directions. It was almost as though he wanted to frustrate Sean to the point of having Sean tell him, “You capture the guy and bring him to the police station.”

          As far as I know, the State only requested the records from Altamonte Medical Services. The Credit Union’s statement shows several debit card transactions at another clinic in small amounts that might be medications, made while GZ lived with the Ostermans. Or it may have been something for ShelLIE. I wish that the State had requested those records too, but since they were in April, it would have extended over the 30 days.

            That is a big problem in that the limitations set by the judge aren’t realistic and the state did not argue for more medical records and psych records as well. They should have known about records that may have been relevant in April for the same reason you know about them. Also on February 27, it was suggested GZ see his psych and RZ, Jr said GZ had post traumatic stress disorder (did MOM say this also?) Why weren’t those psych records asked for by the prosecution?

            That’s a defense matter. If MOM wants to raise that in GZ’s defense, then it’s up to him to present supporting proof. GZ’s depraved mind is proven by his actions on 2/26/12. If GZ wants to blame it on his mental health issues, then he has to provide that evidence — which is highly unlikely to benefit him unless MOM changes his plea to not guilty by reason of insanity.

    I’ve been reading the comments on this blog since this case began. Tonight will be the very first time that I’ve actually made a comment. I think that this site is great because it gives the Trayvon Martin supporters an avenue to look at the evidence in this case in a constructive manner and more importantly, allows people with a rational since of intelligence to be able to determine that George Zimmerman is obviously guilty of killing this kid in cold blood. I’m starting to feel that with this new judge things are starting to head in the wrong direction. It could just be me but it just seems as though she’s trying to give the Defense and George Zimmerman every opportunity and chance to try and prove a self defense claim. For her to deny the Gag order speaks volumes. Also, to allow the defense to have access to Trayvon’s Facebook and Tweeter account without any restrictions is mind-blowing. Not only that, but to also allow them to have access to his girlfriend’s records as well pretty much makes me think that she’s allowing the Defense the opportunity to attack very critical evidence and witnesses that the Prosecution would have at their disposal to help convict this scumbag. What she’s allowing them to do is the same difference as if there were two players who were involved in a high stacks poker game but one player gets to see what the other player is being dealt before that other player even gets the cards. This is BS!!! It’s painfully clear that this judge is, in my opinion, for George Zimmerman and the defense. There is no logically reason for her to allow them access to Trayvon’s and his girlfriend’s social media records. The fact that she also allowed them to have unlimited access but at the same time restricted the prosecution to only have certain information of George Zimmerman’s medical records only after she’s looked at them first is added insult to injury. Today, she has clearly solidified my assumption that she is going to see to it that the state has no legs to stand on in order to prosecute this punk! I mean come on! She even insulted their intelligence by only turning over medical records of the night in question that relates to his so called injuries that he sustained in the altercation with Trayvon. WTH!! The prosecution already had that information! Again, perhaps it’s just me but I’m getting an uneasy feeling about this judge. I’m just saying that in such a high profile case such as this, all things should be looked at when it comes to picking and choosing a judge to fairly reside over this case.     I am now thinking that the “missing piece” that makes both the prosecution and defense act in a way we cannot really understand is that both of them are really still standing on a platform NEITHER of them wants to collapse under them. That platform is the assumption that this event that happened was just an event that arose that night, sui generis, either from George Zimmerman’s criminality (prosecution’s version) or from Trayvon Martin’s criminality (O’Mara’s version). (I don’t call the latter “Zimmerman’s version” because his version is delusional and involves god’s plan.)

    What I think is the actual situation is that it did not arise that night; it did not happen because Trayvon Martin was in the wrong place at the wrong time and it did not arise because one weirdo wacko lying psychologically uncompensated racist half-man chose to pretend he was a little hero. In my book it arose because an inadequate man had a plan and other inadequate men and his inadequate wife pumped him all up about that plan and he thought he could pull it off but he couldn’t, and he killed somebody trying. I think George meant to go out and bring in a criminal that night. Just some fucking punk, whichever one happened to be handy. None appeared so he screwed up and killed an innocent kid trying to do the impossible (trying to deliver “the suspect” when Trayvon Martin was not a suspect at all). The police are guilty of this because they were warned. They DO have a duty to protect once they are warned about life-threatening situations. That’s my take on it.

    Judge Nelson doesn’t read the news or the Internet about this case; she has no way of even imagining this happened. All she will ever hear is what is placed before her in court because she’s a straight-shooter and she’s responsible. So if there is not a full trial, at which O’Mara tries to introduce his foolishness about a conspiracy to improperly charge his client with a crime he committed, then Judge Nelson will only find out about any of this if and when the FBI decides to reveal it and/or act upon it.

    That’s still my guess.

    O’Mara is an experienced litigator. He knows that he can’t change the evidence by carrying on about the “conspiracy to charge George Zimmerman with a crime when he shouldentof-been-noways-nohow.” He’s smarter than those who worship Zimmerman over at the Outhouse. He also knows that the prosecution feels confident of their case because the evidence is pretty damning. So he’s doing whatever it is he does until it’s time to lose the SYG hearing and then plead George out to something. His theatrics are designed to be able to move the plea down. He’s not doing it without both a plan and permission, of a sort, from the prosecution; you can bet on that. They’re moving toward the same point by various means. Judge Nelson, however, is not taking part in the theater and she’s a straight shooter. That’s why she is being very conservative and not seeming to be terribly appalled at any bad behavior. She’s like the parent who won’t listen to the temper tantrum, won’t stop it, but won’t reward it either. That’s the best kind of parent.

            To me it is in MOM’s best interest to keep GZ medicated and with the medication he ensures his client’s mouth is shut. I don’t think MOM would let GZ go through withdrawal and chance another “incident”. At best, I believe MOM realizes GZ is borderline crazy and has led him to a doctor who prescribed heavy-duty medications to prevent another Sean Hannity interview.

            Honestly, to me GZ doesn’t look like a withdrawal victim, just heavily medicated beyond his usual Adderall and tamazepam prescriptions. I have seen patients on medications for mental illness and GZ’s face and actions are consistent with those people who have been heavily medicated rather than patients going through withdrawal symptoms.

            I’ll’ take your word for it. The eye rolling is a sign of anti-depressant withdrawal. It seemed to be worst this past Friday than previously. That is why I was thinking anti-depressant withdrawal.

            At the last two hearings, GZ reminded me of James Holmes. I can’t understand anyone being charged with any degree of murder fighting sleep in the courtroom unless it’s caused by being heavily medicated.

        At some point, MOM will sit with prosecutors and discuss the evidence. As MOM has made clear, GZ’s only self-defense claim is based on a “possible” broken nose. The State is not likely to start at that point — they are going to start with GZ’s profiling of Trayvon.

        Then MOM asks, “What are you offering?” The State replies, “Life in prison.” MOM counters with, “What about manslaughter, 10 yrs and 5 yrs probation?” The State counters, “Assault with a deadly weapon. Statutory 25 yrs.” MOM then says, “I’ll talk with my client.”

        GZ wants to go for immunity. Then GZ is denied immunity, goes to trial, is found guilty of 2nd degree murder, and sentenced to life.

        It’s all God’s plan.

        • That is a very likely scenario. I just don’t see GZ having enough sense to know when to quit digging. He will insist on NO jail time, and there is NO WAY the prosecution (or the public) will allow that. So it’s off to trial and 25-life for the Zim.

          Xena – I don’t think the case hinges on the broken nose. He could have gotten that by a number of means. IMO, the case hinges on the wrist control, the bullet trajectory, and the amazing contortions performed by GZ to get the clean shot. DNA is a good one too. The nose thing — minor.

          Yes, from the prosecution’s position. From the defense position however, and according to O’Mara, he is pursuing traditional self-defense on the basis that GZ was pinned down and had a broken nose. MOM is hoping to avoid evidence that GZ stalked and followed, and wants to jump to the altercation. If he does that, he defaults to the State’s charging affidavit that GZ was the aggressor because he stalked and followed. The State will easily prove that and in doing so, GZ was the aggressor.

        All the plea bargains I have ever see have fallen into two categories, unlike television where they miraculously happen in the initial interview between the prosecutor and some gung-ho defense attorney who just KNOWS the case is unwinnable.

        1. The public defender just plain dictates to the defendant what the plea will be and because the defendant has no money, he has to accept it.

        2. A private lawyer has a relationship with the prosecutor on the case anyway. The private lawyer keeps telling the defendant what they can get and what they can’t get. The prosecutor keeps bringing up something that is not necessarily even relevant. The private lawyer will use that little whatever-it-is (possibly quite irrelevant and sometimes even part of a charge that has already been dropped) to keep the defendants’ friends and supporters and family from advising the defendant to reject the defense lawyer’s proposed plea bargain. Finally the defense lawyer reluctantly agrees to argue with the prosecution for something lower and they go into a meeting without the defendant present. Wow, behold and begrateful, the lawyer comes out with something slightly better than he previously said was “the best he could get.” Who offers it? Nobody “offers” it. They have been talking about it since Day-1. Corey and O’Mara discussed it, you can BET, before Corey even came out and announced her charges. It would not have helped O’Mara’s case any if he admitted to any of that but that’s my cynical take on the whole thing.

      I doubt there will ever be a plea deal in this case. If Zimmerman is convicted, he has to serve a minimum of 25 years under the 10-20-Life law. The judge will have no choice but to sentence him to at least 25 years all the way up to possible life in prison.

          I could be wrong, but GZ no longer looks so sure he is going to win. There is a chance he can win, but IMHO it would involve more corruption and/or an extremely unintelligent jury.

        I think the Marissa Alexander case shows how jurors feel about self-defense. They convicted her for firing a warning shot that did not hurt anybody. If Zimmerman gets the same type of jury, he is literally screwed.

        I hope Alexander gets a new trial. The judge claimed she could have retreated but SYG says you have no duty to retreat. Sometimes I wonder if these idiot judges even read the laws before ruling on them. I hope that judge does not get re-elected and Alexander sues that court into the ground.

          Dennis, that’s because Alexander was in no danger when she fired the gun. Also, self-defense is not firing a “warning shot.” IIRC, Corey offered Alexander a plea of 3 yrs or it may have been 5 yrs.

          IMO, the same violation Alexander was convicted of applies to GZ because he stated that he did not know whether he actually shot Trayvon. Based on that story, rather than be concerned for where his bullet went, GZ lunged on Trayvon’s back. GZ fired his gun in a residential area. Many witnesses gave statements that they hid in the upstairs area of their house because they heard the gunshot.

          Do I feel sorry that Alexander was statutorily sentenced to 20 yrs when no harm was caused to anyone? Sure. The judge’s decision in her case actually patterns that of the judge in another case involving a minor who stabbed a bully killing him. In granting him immunity, the judge said that the statute does not require the person to retreat, but the boy tried to do so before using deadly force to stop the attack on him. It is my impression that those actions address the credibility of the defendant.

        I don’t think the prosecution will budge on the 2nd Degree Murder charge. They could offer him a chance to get paroled someday, but that is about it. Zimmerman is a liar and has shown no remorse so I believe the prosecution would recommend life in prison if he is convicted.

          The no remorse issue is the most problematic to me. If I thought someone was up to no good and I found out later the person I suspected (and killed) was actually just a typical teen kid with no record who was visiting with a person in the neighborhood, I could never forgive myself for having killed him. The Hannity interview showed the true colors of GZ and I hope it comes into play during the trial. The no remorse is one of the reasons I despise his family members and friends trying to defend GZ at the expense of Trayvon’s reputation and further hurting Trayvon’s family when they know Trayvon did nothing wrong and was profiled and killed by GZ..

          Under the circumstances, if GZ walks, I have no faith in the justice system.

        Corrupt prosecutor Angela Corey states that Alexander tried to kill her husband, yet the charge does not reflect that.

        A person as incompetent as this woman is should not be handling the Zimmerman case.

          Dennis, I suppose we come to a point of what source to believe because I read that Alexander said she went into the garage and realized she forgot her keys, then came back into the house with the gun.

          The condition that did not meet SYG is that even if she had been beaten previously, she was not being beaten when she came back into the house.

          See that as it applies to GZ. He could not kill Trayvon for any injuries previously inflicted, and that were not being inflicted placing him under reasonable fear of great bodily harm or death.

          Believe me, I have great compassion for Alexander, but when the facts are applied to the law, she was not standing her ground when she fired the gun. A jury decided her case — not Corey.

        I am disturbed over the case where the boy stabbed the bully to death. The Stand Your Ground law should not exist. If it was self-defense, argue it before a jury. Why are we now letting children with concealed weapons get away with murder for stabbing a bully 12 times to death? I don’t recall seeing any bruises or cuts that would even come close to justifying murder. Getting punched by someone isn’t justification for murder.

          What disturbed me about that case is that no adult intervened before it got that far. Children have come to a point where they don’t involve teachers and parents in bullying because doing so often results in the bullies doing more harmful things once they are exposed. There is a dysfunctional mindset in bullies that enjoys causing others emotional pain.

          Also, I do not believe that self-defense must involve the use of deadly force.

          The Stand Your Ground law should not exist.

          With that, I can agree totally. Cops should never, ever, rely on the statements of the person claiming justifiable homicide and just let them go — have a good day — oh, and here’s your gun back.

        • Forgive me if I don’t have an ounce of sympathy for the dead bully. For a child, bullying takes on an entirely different aspect. Living in fear from a bully that no one will protect you from is much like being stuck in an abusive relationship. If no adults would step in and stop the bullying, then he felt that his life depended on defending himself. I don’t see why they even applied an ADULT standard on a child’s method of thinking. The hitting part is only a PART of the ongoing humiliation heaped on a kid in school. There’s the constant taunting, small hits and “lost” items. No, the child was 100% justified in defending himself in the only he could. The blame falls on the adults that did nothing to stop the bullying.

            I have no sympathy for bullies at all. When I was a kid from about 9 or so up to about 14, every punk in town picked a fight with me because their father, brother, cousin, son, sister, mother, friend or whatever got arrested for something and my dad was the arresting officer.

            What did I have to do with it ?? So, dad being the good dad he was taught me how to fight using methods that inflict as much pain as possible in a quick and easy fashion. I never killed anyone, but as my friends would always say…..the year is still young.

            The point is, most bullying is for a stupid “I’ll inflict my will on you for no actual reason”….reason. That sounds exactly like Z !!!

        Alexander brought it on herself. The fact remains that the trajectory was in the direction of the father and the kids. The riccochet is dangerous too. She also could have left the house. Instead she ran inside with a gun and intent. I think self defense is good but there is too many people abusing the law, thinking they can get away with killing and shooting and are convicted.

          I only knew the results of trial and did not follow that case. Once a jury has spoken, I tend to withhold opinions on the performance of legal counsel; defense and prosecution. If there is an appellable issue, I say go for it. Maybe that is the way of protecting my emotions and stress level after working in courts and the law. Laws legislated to protect some victimize others. That’s how I see SYG.

    I hope this is a good move by Judge Nelson and, I feel that a muzzle should have been put on O’Mara a long time ago. he gets away with talking about this case on two web sites that he set up and, Judge Stan Strickland got pulled off of the Casey Anthony trial for basically the same thing, in his communication with Marinade Dave. if O’Mara wants to continue talking that’s fine but, he should be made to take down his social network sites.

    Maybe its still a good thing… I mean Omara gets the message to watch what he says because the judge said it wasnt overriding, which to me sounds like she means he is doing it somewhat, but on the line of crossing over. Besides, she gave options on what will happen to make sure a proper jury is seated on the order. I feel its fine.
